The OACIQ is concerned about a recent decision rendered by the Court of Quebec
In 2009, the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ) brought a lawsuit before the Criminal and Penal Division of the Court of Quebec against DuProprio Inc. The OACIQ alleged that some activities of DuProprio Inc., especially in regard to advertising, violated the Real Estate Brokerage Act, since the enterprise had acted in a way leading public to believe that it was authorized to act as a real estate broker or agent, whereas it was not holding a certificate for this purpose.
Illegal practice
In Quebec, any real estate brokerage transaction, for compensation and for others, must be carried out by a duly certified real estate broker or agent, i.e. one who holds a certificate to practice issued by the ACAIQ.
