Here are the highlights and main changes included in the new Real Estate Brokerage Act.

Bill 73 – Real Estate Brokerage Act: A new, modern system of supervision, in tune with today’s practice

Tabled before the National Assembly in December 2007 by Monique Jérôme-Forget, Minister of Finance, this Bill, intended to replace the current Real Estate Brokerage Act, was adopted and sanctioned last May. Although no specific date has yet been set, it is expected that the new legislation will come into effect at the beginning of 2009.

Deactivation of current training programs deferred

The Association des courtiers et agents immobiliers du Québec has just been informed by the Ministère de l’Éducation, du Loisir et du Sport that deactivation of programs 902.56 Real Estate Agent and 902.57 Real Estate Broker has been deferred. This deactivation, which was scheduled for January 1, 2009, has been postponed to January 1, 2010.

Training requirements for obtaining a certificate

Individuals are required to have a college-level training the field of real estate to work as a real estate agent or broker. Course curriculums will vary according to the type of certificate required. You will find below under "Requirements" all the courses required for each category of certificate. A person may be exempted from taking one or more of these courses where a general and vocational college offering those courses grants him an equivalence. Take note that such equivalence may be granted by a cegep only.

Official publication of the OACIQ regulations by the government: analysis and highlights

On April 14, we issued a special InfoLetter informing you of the publication in the Gazette officielle du Québec of the order proclaiming the coming into force of the new Real Estate Brokerage Act and the seven regulations thereunder. These regulations are based on the principles contained in the draft regulations published on January 13.

Mandatory education activity on the new Real Estate Brokerage Act: schedule and registration procedures

Bill 73 and mortgage brokerage authorized under the Act respecting the distribution of financial products and services (D designation)

When the new Real Estate Brokerage Act comes into force, brokerage activities relating to loans secured by immovable hypothec will be exclusively governed by this Act. Individuals or partnerships governed by the Act respecting the distribution of financial products and services and authorized to engage in brokerage activities relating to loans secured by immovable hypothec will have to be licensed by the OACIQ to continue being authorized to do so.
