Notices of suspension or licence revocation or imposition of conditions or limitations to a licence.

The discipline committee has the power to suspend or revoke the licence of a licence holder or broker or to impose conditions or limitations if he does not act according to the Laws and regulations of Real Estate Brokerage. In such a case, a notice of the committee’s decision must be published or inserted within an official or regular publication of the Organisme or on its Web site. Furthermore, the discipline committee can decide to publish a notice of its decision inside a newspaper circulating on the territory where the licence holder or broker has its establishment.

The notices of suspension or licence revocation or imposition of conditions or limitations to a licence are public.

CLARIFICATION REGARDING THE REFERENCE TO THE BROKER WITHIN THE NOTICES OF SUSPENSION PUBLISHED

Please take not that the reference to the broker who employs or authorizes to act the suspended licence holder does not imply in any way that the licence holder was employed or authorized to act by that same broker when he committed the infractions for which he was declared guilty.

The Real Estate Brokerage Law and its regulations required that the notices of suspension of certificates refer to the place of practice of the targeted member when the suspension of his certificate took place or, failing that, to his last professional place of practice. This ‘’place of practice’’ is found at the broker who employs or authorizes him to act or, failing that, at the last broker who employed or authorized him to act.
