To adapt to the latest technological developments and other trends that characterize today's society, the National Assembly has adopted the Act to modernize legislative provisions as regards the protection of personal information. Most of the provisions of this Act will come into force on September 22, 2023.

This Act gives individuals more rights regarding the use of their personal information. It imposes new obligations on licensees when handling their clients' personal information. These obligations also apply to the other parties to the transaction.

 

WHY A GUIDELINE?

This guideline is a reference tool to support your decisions, including in matters of compliance. This guideline simplifies the legislative and regulatory framework of real estate brokerage. It clarifies the OACIQ’s expectations and sets out proper practices to ensure licensee compliance. It will help real estate agencies and their executive officers to develop a comprehensive and effective compliance program. However, this guideline does not cover all aspects of personal information handling reform, but only those that may have an impact on the real estate brokerage practice. It is the licensees' responsibility to ensure that they comply with the requirements of the Act respecting the protection of personal information in the private sector (R.S.Q. c. P-39.1). Always follow the recommendations of the Commission d’accès à l’information in relation to the recent reform.1
