Because of your role as agency executive officer, the consequences of an expired photo are not insignificant as they may not only have a direct impact on your licence, but also on that of the agency and the brokers acting on its behalf.
An up-to-date photo to avoid your licence suspension
According to the Regulation respecting the issue of broker’s and agency licences, your photo is valid for five years from the time it was taken. You must have a valid photo to keep your licence active, otherwise your licence will be suspended. For more information on the general consequences of a suspension, read this article.
Because of your role as agency executive officer, additional consequences also apply to the licence of your agency and the brokers working for it. Here are the details:
What will happen to the agency's licence if your licence is suspended?
Agency “Legal person and corporation”:
If your own licence is suspended, the agency will have 60 days to appoint a licence holder who is qualified to act as an executive officer. If you fail to do so within the specified period, the agency’s licence will be suspended.
If the agency licence is suspended, this will result in:
- The suspension of the agency brokers’ licences
- The immediate cessation of all brokerage activities by the agency and its brokers
- The automatic termination of current brokerage contracts
- The obligation to immediately notify in writing the parties with brokerage contracts in progress that the agency, you, or the brokers acting on its behalf, are no longer authorized to represent them
- The obligation to remove all ads immediately
Agency "Natural person":
If your own licence is suspended, the agency’s licence will also be suspended.
If the agency licence is suspended, this will result in:
- The suspension of the agency brokers’ licences
- The immediate cessation of all brokerage activities by the agency and its brokers
- The automatic termination of current brokerage contracts
- The obligation to immediately notify in writing the parties with brokerage contracts in progress that the agency, you, or the brokers acting on its behalf, are no longer authorized to represent them
- The obligation to remove all ads immediately
