NOTICE OF IMPOSITION OF CONDITIONS AND RESTRICTIONS
ON PATRICK DOYON’S LICENCE

NOTICE is hereby given that Patrick Doyon, real estate broker (licence D4423), whose establishment is located in Sainte-Catherine, has had conditions and restrictions imposed on his licence, following a decision by the Licence Issue and Maintenance Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ), pursuant to section 38 (2) of the Real Estate Brokerage Act.

On January 26, 2023, the Licence Issue and Maintenance Committee imposed the following conditions and restrictions on Mr. Patrick Doyon’s licence:
  1. Within six (6) months of notification of this decision, he must complete the training course entitled “The broker as a self-employed worker,” provided by the OACIQ Training Department or any other training deemed equivalent by the OACIQ.
 
  1. Within 30 days of notification of this decision, the licensee shall send the OACIQ Registry Service proof of his registration for the training mentioned in paragraph (a).
 
  1. The licensee shall be prohibited from carrying on activities on his own account and from being designated as agency executive officer and/or from acting as one until the next decision of the Committee.
 
  1. Until the next decision of the Committee, the licensee shall enter into and maintain a written agreement with the agency within which he carries on his activities to the effect that the latter holds in trust the GST and QST payable to him, as a real estate broker, until he is required to remit them along with his tax return.
 
  1. Until the next decision of the Committee, the licensee shall enter into and maintain a written agreement with the agency within which he carries on his activities to the effect that the latter holds in trust a minimum of 20% of his remuneration to pay his taxes, until he is required to remit it upon presentation of his notices of assessment, or in order to make instalment payments.
 
  1. A copy of the agreement mentioned in paragraphs (d) and (e) shall be sent to the OACIQ Registry Service within thirty (30) days of the notification of this decision.
 
  1. In the event of any agency change, the licensee must enter into a new agreement under the same conditions with the new agency and send a copy thereof to the Organization’s Registry Service within 30 days following the agency change.
 
  1. The licensee shall forward any documents filed in his bankruptcy record to the Organization's Registry Service no later than 30 days following the date of filing.
 
  1. The licensee shall send proof of application for his new GST/QST numbers to the OACIQ Registry Service within 30 days following notification of this decision; he shall then provide proof of the obtainment of his new GST/QST numbers.
 
  1. The licensee shall send proof of filing of his 2022 tax returns to the OACIQ Registry Service within 30 days following the due date for their filing.
 
  1. The licensee shall send his 2022 assessment notices and proof of their payment within 30 days of their due date.
 
     l. The licensee shall send proof of filing and payment of his GST/QST returns within 30 days of their due date.
  1. The licensee's file will be submitted to the Committee in 2024.
 
Should Mr. Patrick Doyon fail to comply with the above conditions and restrictions, his right to engage in real estate brokerage activities shall be suspended until he does so.

This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences.

The decision became enforceable on February 23, 2023.
