NOTICE OF IMPOSITION OF RESTRICTIONS AND CONDITIONS
ON MR. MICHEL LABRIE’S LICENCE

NOTICE is hereby given that Michel Labrie, real estate broker (licence C7874), whose establishment is located in Lasalle, has had conditions and restrictions imposed on his licence, following a decision by the Licence Issue and Maintenance Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ), pursuant to section 38 (2) of the Real Estate Brokerage Act (CQLR, c. C-73.2).
 
On October 21, 2020, the Licence Issue and Maintenance Committee imposed the following conditions and restrictions on Mr. Labrie’s licence:
 
That it is appropriate to suspend Mr. Labrie’s licence until he is discharged from bankruptcy and to impose the following conditions on his licence, which will be enforceable from the time he obtains the lifting of his licence suspension:
 

  1. He must complete, within a 3-month period following the lifting of his licence suspension, the training entitled “The broker as a self-employed worker”, provided by the OACIQ Continuing Education Department or any other equivalent training accredited by the OACIQ, in addition to courses that he must take to meet his continuing education obligations;
 
  1. For a period of three (3) years following the lifting of his licence suspension, the licence holder shall enter into and maintain a written agreement with the agency within which he carries on his activities to the effect that the latter holds in trust the GST and QST payable to him, as a real estate broker, until he is required to remit them to government authorities. The sums withheld by the agency for this purpose shall be remitted to the licence holder upon the filing of his tax return;
 
  1. A copy of this agreement shall be forwarded to the OACIQ Registry Service within thirty (30) days following the lifting of his licence suspension;
 
  1. Within 30 days following the lifting of his licence suspension, he shall forward to the OACIQ Registry Service an agreement entered into with his agency executive officer, by which the latter undertakes to specifically supervise and oversee his practice for a period of three (3) years following the establishment of an oversight plan;
 
  1. Within 60 days following the lifting of his licence suspension, he shall forward to the OACIQ Registry Service the three-year oversight plan established with his agency executive officer, which shall include:
 
  1. Verifying brokerage contract files before an immovable or enterprise is put on the market;
 
  1. Verifying transactions and monitoring their progress;
 
  1. Supervising the licence holder's progress by providing for regular meetings and ensuring that he completes relevant training activities related to his obligations.
 
  1. In the event of a change of agency during the periods mentioned in items b), d) and e), a new agreement and a new oversight plan shall be entered into with the new agency’s executive officer, under the same conditions and for the remaining term, and be forwarded to the OACIQ Registry Service within ten (10) days of the agency change;
 
  1. To be able to lift his licence suspension, he must send to the OACIQ Registry Service a copy of his certificate of discharge or any other document proving that he is discharged from bankruptcy, in addition to meeting other requirements set out in the Real Estate Brokerage Act and its regulations.
 
Should Mr. Michel Labrie fail to comply with the above conditions and restrictions, his right to engage in real estate brokerage activities shall be suspended until he does so.
 
This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences (R.R.Q., c. C-73.2, r. 3).
 
The decision became enforceable on December 7, 2020.
