NOTICE OF IMPOSITION OF CONDITIONS AND RESTRICTIONS
ON RYAN LUBELL-SMITH’S LICENCE

NOTICE is hereby given that Ryan Lubell-Smith, real estate broker, licence number F0576, whose establishment is located in Pointe-Claire, has had conditions and restrictions imposed on his licence, following a decision by the Licence Issue and Maintenance Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ), pursuant to section 38 ((2) of the Real Estate Brokerage Act.

On September 1, 2022,  the Licence Issue and Maintenance Committee imposed the following conditions and restrictions on Mr. Ryan-Lubell Smith:

a) Within six (6) months of notification of this decision, he must complete the training course entitled “The broker as a self-employed worker,” provided by the OACIQ Continuing Education Department or any other equivalent training accredited by the OACIQ.

b) Within 30 days of notification of this decision, send the OACIQ Registry Service proof of his registration for the training mentioned in paragraph a).

c) As of the notification of this decision until 36 months following his discharge from bankruptcy, prohibiting him from carrying on activities on his own account and from being designated as agency executive officer and/or from acting as one.

d) As of the notification of this decision until 36 months following his discharge from bankruptcy, the licensee shall enter into and maintain a written agreement with the agency within which he carries on his activities to the effect that the latter holds in trust the GST and QST payable to him, as a real estate broker, until he is required to remit them along with his tax return.

e) As of the notification of this decision until 36 months following his discharge from bankruptcy, the licensee shall enter into and maintain a written agreement with the agency within which he carries on his activities to the effect that the latter holds in trust a percentage of his remuneration to pay his taxes.

f) A copy of the agreement mentioned in paragraphs d) and e) shall be sent to the OACIQ Registry Service within thirty (30) days of the notification of this decision.

g) In the event of any agency change during the period mentioned in paragraphs d) and e), the licensee must enter into an agreement under the same conditions with the new agency and send a copy thereof to the Organization’s Registry Service within 30 days following the agency change.

h) Within 30 days following notification of this decision, the licensee shall send the Organization’s Registry Service proof of his withdrawal as a director from the business corporation Ryan Lubell-Smith courtier immobilier Inc.         

i) He shall send his certificate of discharge from bankruptcy to the OACIQ Registry Service within 30 days of his discharge.

j) Should the licensee not be discharged from his bankruptcy by January 27, 2024, his file will be resubmitted to the Committee.

Should Mr. Ryan Lubell-Smith fail to comply with the above conditions and restrictions, his right to engage in real estate brokerage activities shall be suspended until he does so.

This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences.

The decision became enforceable on September  19, 2022.
