NOTICE OF IMPOSITION OF CONDITIONS AND RESTRICTIONS
ON SÉBASTIEN CLOUTIER’S LICENCE

NOTICE is hereby given that Sébastien Cloutier, residential real estate broker, licence number G4217, whose establishment is located in Saint-Jean-sur-Richelieu, has had conditions and restrictions imposed on his licence, following a decision by the Licence Issue and Maintenance Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ), pursuant to section 38 (2) of the Real Estate Brokerage Act.

On June 5, 2024, the Licence Issue and Maintenance Committee imposed the following conditions and restrictions on Mr. Cloutier’s licence:


That it is appropriate to maintain Mr. Cloutier’s real estate broker’s licence and impose the following conditions and restrictions:
 

  1. For 60 months following the notification of this decision, the licensee will be prohibited from carrying on real estate brokerage activities on his own account.
 
  1. Up to 60 months following the notification of this decision, the licensee will be prohibited from carrying on real estate brokerage activities within a business corporation.
 
  1. For 60 months following the notification of this decision, the licensee shall enter into and maintain a written agreement with the agency within which he carries on his real estate brokerage activities to the effect that the latter retains the GST and QST payable to him until he is required to remit them, upon transmission of his tax return to be kept in the agency's file.
 
  1. Up to 60 months following the notification of this decision, the licensee shall enter into and maintain a written agreement with the agency within which he carries on his real estate brokerage activities to the effect that the latter holds a minimum of 20% of his remuneration to pay his taxes, until such time as he is required to remit it, upon transmission of a copy of his notices of assessment, or in order to make instalment payments.
 
  1. A copy of the agreement mentioned in paragraphs (c) and (d) shall be sent to the OACIQ Registry Service within thirty (30) days of notification of this decision.
 
  1. In the event of any agency change during the period mentioned in paragraphs (c) and (d), the licensee must enter into a new agreement under the same conditions with the new agency and send a copy thereof to the Organization’s Registry Service within 30 days following the agency change.
 
  1. The 60-month period shall end only upon the completion of this period with an active real estate broker's licence.
 
  1. The 60-month period shall be suspended in the event the licensee suspends or revokes his real estate broker's licence.

Should Mr. Cloutier fail to comply with the above conditions and restrictions, his right to engage in professional real estate brokerage activities shall be suspended until he does so.

This notice is given in accordance with section 33 of the Regulation respecting broker’s and agency licences.

The decision became enforceable on August 16, 2024.
