NOTICE OF IMPOSITION OF CONDITIONS AND RESTRICTIONS
ON MELISSA BARTAKIZ’S LICENCE

NOTICE is hereby given that Melissa Bartakiz, real estate broker, licence G7059, whose establishment is located in Pincourt, has had conditions and restrictions imposed on her licence, following a decision by the Licence Issue and Maintenance Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ), pursuant to section 38 (2) of the Real Estate Brokerage Act.

On June 5, 2024, the Licence Issue and Maintenance Committee imposed the following conditions and restrictions on Ms. Bartakiz:
  1. Within 6 months of notification of this decision, the licensee must complete the training course entitled “The broker as a self-employed worker,” provided by the OACIQ Training Department.
 
  1. Within 30 days of notification of this decision, the licensee shall send the OACIQ Registry Service proof of her registration for the training mentioned in paragraph (a).
 
  1. Within 3 months of notification of this decision, the licensee must take the training course "McGill Personal Finance Essentials" and send proof thereof to the OACIQ Registry Service.
 
  1. As of the notification of this decision and up to 24 months following her discharge from bankruptcy, the licensee shall be prohibited from carrying on real estate brokerage activities on her own account.
 
  1.  From the notification of this decision and up to 24 months after her discharge from bankruptcy, the licensee shall be prohibited from carrying on real estate brokerage activities within a business corporation.
 
  1. As of the notification of this decision and up to 24 months following her discharge from bankruptcy, the licensee shall enter into and maintain a written agreement with the agency within which she carries on her real estate brokerage activities to the effect that the latter retains the GST and QST payable to her until she is required to remit them, upon transmission of her tax return to be kept in the agency's file.
 
  1. As of the notification of this decision and up to 24 months following her discharge from bankruptcy, the licensee shall enter into and maintain a written agreement with the agency within which she carries on her real estate brokerage activities to the effect that the latter holds a minimum of 20% of her remuneration to pay her taxes, until such time as she is required to remit it, upon transmission of a copy of her notices of assessment, or in order to make instalment payments.
 
  1. A copy of the agreement mentioned in paragraphs (f) and (g) shall be sent to the OACIQ Registry Service within thirty (30) days of notification of this decision.
 
  1. In the event of any agency change during the period mentioned in paragraphs (f) and (g), the licensee must enter into a new agreement under the same conditions with the new agency and send a copy thereof to the Organization’s Registry Service within 30 days following the agency change.
 
  1. The licensee shall send the Organization’s Registry Service her certificate of discharge from bankruptcy as soon as possible after its receipt.
 
  1. Should the licensee not be discharged automatically from her bankruptcy, her file will be resubmitted to the Committee.
If Ms. Bartakiz fails to comply with the conditions and restrictions imposed, her right to engage in real estate brokerage activities shall be suspended until she does so.

This notice is given in accordance with section 33 of the Regulation respecting broker’s and agency licences.

The decision became enforceable on July 29, 2024.
