NOTICE OF IMPOSITION OF CONDITIONS AND RESTRICTIONS ON JOËL DESMARAIS’ LICENCE

Notice is hereby given that Joël Desmarais, full-service real estate broker (licence D8479), whose establishment is located in Granby, has had conditions and restrictions imposed on his licence following a decision by the Licence Issue and Maintenance Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ), pursuant to section 38 (2) of the Real Estate Brokerage Act.

On July 31, 2025, the Licence Issue and Maintenance Committee imposed the following conditions and restrictions on Mr. Desmarais’ licence:
  1. Within 6 months of notification of this decision, the licensee must complete the training course entitled “The broker as a self-employed worker,” provided by the OACIQ Training Department.
  2. Within 3 months of notification of this decision, the licensee must take the training course "McGill Personal Finance Essentials" and send proof thereof to the OACIQ Registry Service.
  3. The licensee shall be prohibited from carrying on real estate brokerage activities on his own account from notification of this decision until 60 months following notification of this decision. 
  4. The licensee shall be prohibited from carrying on real estate brokerage activities within a business corporation from notification of this decision until 60 months following notification of this decision. 
  5. For 60 months following notification of this decision, the licensee shall enter into and maintain a written agreement with the agency within which he carries on his real estate brokerage activities to the effect that the latter retains the GST and QST payable to him until he is required to remit them, upon transmission of his tax return to be kept in the agency's file.
  6. Up to 60 months following notification of this decision, the licensee shall enter into and maintain a written agreement with the agency within which he carries on his real estate brokerage activities to the effect that the latter holds 25% of his remuneration for the purpose of paying his taxes, until such time as he is required to remit it, upon transmission of a copy of his notices of assessment, or for the purpose of making instalment payments.
  7. A copy of the agreement mentioned in paragraphs (e) and (f) shall be sent to the OACIQ Registry Service within 30 days of notification of this decision.
  8. The licensee shall send the OACIQ Registry a copy of his federal and provincial notices of assessment and proof of their payment, as well as proof of filing and payment of his GST/QST returns, no later than  August 15 of each taxation year, as of 2026 and for a period of 48 months.
  9. In the event of any agency change during the period referred to in this decision, the licensee shall enter into a new agreement under the same conditions with the new agency and send a copy thereof to the Organization’s Registry Service within 30 days following the agency change.
  10. All the periods mentioned in this decision shall end only upon the completion of such periods with an active real estate broker's licence.
  11. All the periods mentioned in this decision shall be suspended in the event the licensee suspends or revokes his real estate broker's licence. 

Should the licensee fail to comply with the above conditions and restrictions, his real estate broker's licence shall be suspended until he does so.

This notice is given in accordance with section 33 of the Regulation respecting broker’s and agency licences.

The decision became enforceable on September 29, 2025.
