NOTICE OF IMPOSITION OF CONDITIONS AND RESTRICTIONS ON ELIAHOU BARCHICHAT’S LICENCE

Notice is hereby given that Eliahou Barchichat, full-service real estate broker (licence G1075), whose establishment is located in Westmount, has had conditions and restrictions imposed on his licence following a decision by the Licence Issue and Maintenance Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ), pursuant to section 38 (1) of the Real Estate Brokerage Act.

On July 31, 2025, the Licence Issue and Maintenance Committee imposed the following conditions and restrictions on Mr. Barchichat’s licence:
  1. Within 6 months of notification of this decision, the licensee must take the following training activity and send proof thereof to the OACIQ Registry Service: “The keeping of records and registers,” provided by the OACIQ Training Department.
  2. Within 6 months of notification of this decision, the licensee must take the following training activity and send proof thereof to the OACIQ Registry Service. “Documenting commercial brokerage records,” provided by the OACIQ Training Department.
  3. Within 6 months of notification of this decision, the licensee must take the following training activity and send proof thereof to the OACIQ Registry Service: “Record documentation,” provided by the OACIQ Training Department.
  4. Within 12 months of notification of this decision, the licensee must take the following training activity and send proof thereof to the OACIQ Registry Service: “Transparency in your services and fulfilment of your professional commitments,” provided by the OACIQ Training Department.
  5. Within 12 months of notification of this decision, the licensee must take the following training activity and send proof thereof to the OACIQ Registry Service: “The Declarations by the seller of the immovable and the broker's duty to verify, inform and advise,” provided by the OACIQ Training Department.
  6. Within 12 months of notification of this decision, the licensee must take the following training activity and send proof thereof to the OACIQ Registry Service: “Hidden defects and legal warranty,” provided by the law firm Chamoun Legal Inc.
  7. Within 3 months of notification of this decision, the licensee shall send the OACIQ Registry Service proof of his registration for the training activities mentioned in paragraphs (a), (b) and (c).
  8. Within 9 months of notification of this decision, the licensee shall send the OACIQ Registry Service proof of his registration for the training activities mentioned in paragraphs (d), (e) and (f).
  9. For 36 months following the notification of this decision, the licensee shall be prohibited from carrying on real estate brokerage activities on his own account.
  10. For 36 months following the notification of this decision, the licensee shall be prohibited from carrying on real estate brokerage activities within a business corporation.
  11. The licensee shall inform the OACIQ Registry Service of his licence reactivation with the Autorité des Marchés Financiers within 30 days.
  12. The 36-month period shall end only upon its completion with an active real estate broker's licence.
  13. The 36-month period shall be suspended in the event the licensee suspends or revokes his real estate broker's licence.

Should the licensee fail to comply with the above conditions and restrictions, his real estate broker's licence shall be suspended until he does so.

This notice is given in accordance with section 33 of the Regulation respecting broker’s and agency licences.

The decision became enforceable on September 29, 2025.
