NOTICE OF IMPOSITION OF CONDITIONS AND RESTRICTIONS ON THE LICENCE OF HANNAH BEHELAK

Notice is hereby given that Hannah Behelak, real estate broker restricted to residential brokerage, licence No. G4755, whose establishment is located in Beaconsfield, has had conditions and restrictions imposed on her licence following a decision by the Licence Issue and Maintenance Committee of the Organisme d’autoréglementation du courtage immobilier du Québec, pursuant to section 38 (2) of the Real Estate Brokerage Act.

On June 19, 2025, the Licence Issue and Maintenance Committee imposed the following conditions and restrictions on Mrs. Behelak’s licence:
 
  1. Within 6 months following notification of this decision, the licence holder shall complete the training course entitled “The broker as a self-employed worker” provided by the OACIQ Training Department.
  2. Within 30 days following notification of this decision, the licence holder shall send to the OACIQ Registry proof of her registration for the training mentioned in paragraph a).
  3. Within 3 months following notification of this decision, the licence holder shall complete the training course “McGill Personal Finance Essentials” and send proof thereof to the OACIQ Registry.
  4. The licence holder shall be prohibited from carrying on real estate brokerage activities on her own account from notification of this decision until 36 months after the discharge of her bankruptcy.
  5. The licence holder shall be prohibited from carrying on real estate brokerage activities within a business corporation from notification of this decision until 36 months after the discharge of her bankruptcy.
  6. The licence holder shall maintain a written agreement with the agency on behalf of which she carries on her real estate brokerage activities, to the effect that the latter shall hold the GST/QST payable to her until she is required to remit them, upon filing of her tax return to be kept in the agency’s records, from notification of this decision until 36 months after the discharge of her bankruptcy.
  7. The licence holder shall maintain a written agreement with the agency on behalf of which she carries her real estate brokerage activities, to the effect that the latter shall hold a minimum of 20% of her remuneration for the purpose of paying her income taxes, until remittance is required upon presentation of a copy of her notices of assessment, or for the purpose of paying instalments, from notification of this decision until 36 months after the discharge of her bankruptcy.
  8. A copy of the agreement mentioned in paragraphs f) and g) shall be sent to the OACIQ Registry within 30 days following notification of this decision.
  9. In the event of an agency change during the period mentioned in this decision, the licence holder shall enter into a new agreement under the same conditions with the new agency, and send a copy thereof to the OACIQ Registry within 30 days following the agency change.
  10. The 36-month period will end only once it has been completed while the holder has an active real estate broker’s licence.
  11. The 36-month period will be suspended if the holder suspends or revokes her real estate broker’s licence.
  12. Within 30 days following notification of this decision, the licence holder shall send to the OACIQ Registry proof of her application for and subsequent receipt of her new GST/QST numbers.
  13. The licence holder shall forward her bankruptcy discharge certificate to the OACIQ Registry by July 26, 2027 at the latest
  14. In the event that the licence holder’s bankruptcy is not discharged by June 26, 2026, her case will be re-submitted to the Committee.
Should Mrs. Hannah Behelak fail to comply with the above conditions and restrictions, her right to carry out professional real estate brokerage activities shall be suspended until she does so.

This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences.

This notice became enforceable on August 19, 2025.
