NOTICE OF IMPOSITION OF RESTRICTIONS AND CONDITIONS
TO THE LICENCE OF NASSIM TABAT
NOTICE is hereby given that Mr. Nassim Tabat, residential real estate broker, licence No. H2294, whose establishment is located in Pincourt had conditions and restrictions imposed on his licence following a decision by the Licence Issue and Maintenance Committee of the Organisme d’autoréglementation du courtage immobilier du Québec, pursuant to section 37 (3) of the Real Estate Brokerage Act (R.S.Q., c. C-73.2).
On June 18, 2019, the Licence Issue and Maintenance Committee imposed the following conditions and restrictions to the licence of Mr. Nassim Tabat:
a) Within thirty (30) days following issuance of his licence, he shall send to the OACIQ Registry an agreement entered into with his agency executive officer to the effect that the latter specifically undertakes to supervise and oversee the applicant’s practice, for a period of two (2) years following the establishment of this oversight plan;
b) Within sixty (60) days following issuance of his licence, the applicant shall send to the OACIQ Registry the two-year oversight plan established with his agency executive officer, which shall include, among other things:
1) verifying the applicant’s brokerage contract records before an immovable or enterprise can be put on the market;
2) verifying transactions and monitoring of their progress;
3) supervising the applicant's progress by scheduling regular meetings and ensuring completion of relevant training activities related to his obligations.
c) The executive officer of the agency within which he will carry on his activities shall send a written report to the AOCIQ Registry every six (6) months, starting from the time of establishment of the oversight plan. Written reports will focus on the compliance of the applicant’s practice and will indicate, in particular:
1) Whether the applicant is collaborating to enable the agency to properly discharge its supervision and oversight duty;
2) Whether the applicant complies with all the rules that apply to him.
d) In the event of a change of agency, a new agreement and a new oversight plan shall be entered into with the executive officer of the new agency, under the same conditions, for the remainder of the term, and shall be forwarded to the OACIQ Registry within ten (10) days of the change of agency;
e) The applicant shall be prohibited from acting as agency executive officer or from carrying on activities on his own account for a period of three (3) years following issuance of his licence.
Should he fail to comply with the above conditions and restrictions, his right to engage in professional real estate brokerage activities shall be suspended until he meets these conditions
This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences (R.R.Q., c. C-73.2, r. 3).
