NOTICE OF IMPOSITION OF CONDITIONS AND RESTRICTIONS
ON MS. ANA NOLASCO’S LICENCE

NOTICE is hereby given that Ms. Ana Nolasco, real estate broker (licence H3938), whose establishment is located in Montréal has had conditions and restrictions imposed on her licence, following a decision by the Licence Issue and Maintenance Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ), pursuant to section 37 (2) of the Real Estate Brokerage Act (CQLR, c. C-73.2).

On December 8, 2020, the Licence Issue and Maintenance Committee imposed the following conditions and restrictions on Ms. Ana Nolasco’s licence:

a) Within six (6) months following her licence issuance, she shall complete the training course entitled “The broker as a self-employed worker,” provided by the OACIQ Continuing Education Department or any other equivalent training accredited by the OACIQ, in addition to courses that she must take to meet her continuing education obligations;

b) For a period of two (2) years following her licence issuance, she shall enter into and maintain a written agreement with the agency within which she carries on her activities to the effect that the latter holds in trust the GST and QST payable to her as a real estate broker, until she is required to remit them to government authorities. The sums withheld by the agency for this purpose shall be remitted to the licence holder upon the filing of her tax return;

c) A copy of this agreement shall be sent to the OACIQ Registry Service, within thirty (30) days following the notification of this decision;

d) In the event of any agency change during the period mentioned in item b), she must enter into an agreement under the same conditions with the new agency and send a copy thereof to the OACIQ Registry Service, within 30 days following the agency change;

e) For a period of two (2) years following the issuance of her licence, prohibiting her from carrying on activities on her own account and from being designated and/or from acting as agency executive officer;

f) Within 60 days of receipt of this decision, Ms. Nolasco must send the OACIQ Registry Service a payment agreement or proof of payment of the amount of $4,228.05 plus interest and costs, if applicable, for the purpose of discharge from bankruptcy;

g) Following discharge from bankruptcy, she shall provide the OACIQ Registry Service with her certificate of discharge as soon as possible

If Ms. Ana Nolasco fails to comply with the conditions imposed, her right to engage in real estate brokerage activities will be suspended until she does so.

This notice became enforceable on February 1st, 2021.

This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences (R.R.Q., c. C-73.2, r. 3).
