NOTICE OF IMPOSITION OF CONDITIONS AND RESTRICTIONS
ON KAROLANN SIMARD’S LICENCE

NOTICE is hereby given that Karolann Simard, real estate broker restricted to residential brokerage, licence number G6648, whose establishment is located in Lachine, has had conditions and restrictions imposed on her licence following a decision by the Licence Issue and Maintenance Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ), pursuant to section 37 (2) of the Real Estate Brokerage Act.

On June 23, 2022, the Licence Issue and Maintenance Committee imposed the following conditions and restrictions on Ms. Simard’s licence:

a) Within six months following issuance of her licence, in addition to any training activities she must complete to meet her continuing education obligations, the applicant shall complete the training course entitled “The broker as a self-employed worker,” provided by the OACIQ Continuing Education Department, or any other training accredited by the OACIQ deemed equivalent.

b) Within 30 days following issuance of her licence, the applicant shall send to the OACIQ Registry Service proof of her registration for the training mentioned in paragraph a).

c) For a period of 12 months following issuance of her licence, the applicant shall be prohibited from carrying on activities on her own account or from being designated and/or acting as agency executive officer.

d) For a period of 12 months following issuance of her licence, the applicant shall enter into and maintain a written agreement with the agency on behalf of which she carries on her professional activities to the effect that the latter shall hold in trust the GST/QST payable to the applicant, as real estate broker, until she is required to remit these taxes together with her return.

e) For a period of 12 months following issuance of her licence, the applicant shall enter into and maintain a written agreement with the agency on behalf of which she carries on her professional activities to the effect that the latter shall hold in trust a percentage of the applicant’s remuneration in order to pay her income taxes. The percentage shall be agreed upon between the applicant and her agency.

f) The applicant shall send a copy of the agreement mentioned in paragraphs d) and e) to the OACIQ Registry Service within thirty (30) days following notification of this decision.

g) In the event of an agency change during the period mentioned in paragraphs d) and e), the applicant shall enter into an agreement under the same conditions with the new agency, and send a copy thereof to the Organization’s Registry Service within 30 days following the change.

h) The period referred to in paragraphs c), d) and e) shall be suspended in the event the applicant suspends or revokes her real estate broker's licence.

i) The period referred to in paragraphs c), d) and e) shall end when the applicant has completed 12 months as an active real estate broker licence holder following issuance of her licence.

j) The applicant shall send proof of her new GST/QST numbers to the OACIQ Registry Service within 30 days following issuance of her licence.

Should the applicant fail to comply with the above conditions and restrictions, her right to engage in professional real estate brokerage activities shall be suspended until she does so.

This notice became enforceable on August 15, 2022.

This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences.
