NOTICE OF IMPOSITION OF CONDITIONS AND RESTRICTIONS
ON MOURAD KHEMIRI’S LICENCE

NOTICE is hereby given that Mourad Khemiri, full-service real estate broker (licence H6712), whose establishment is located in Longueuil has had conditions and restrictions imposed on his licence following a decision by the Licence Issue and Maintenance Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ), pursuant to section 37 (2°) of the Real Estate Brokerage Act.

On April 21, 2022, the Licence Issue and Maintenance Committee imposed the following conditions and restrictions on Mr. Khemiri:

a) He must complete, within a 6-month period following the issuance of his licence, the training entitled “The broker as a self-employed worker”, provided by the OACIQ Continuing Education Department or any other equivalent training accredited by the OACIQ, in addition to courses that he must take to meet his continuing education obligations.

b) Within 30 days of issuance of his licence, send to the OACIQ Registry Service proof of his registration for the training mentioned in paragraph a).

c) For a period of 24 months following his licence issuance, prohibiting him from carrying on activities on his own account and from being designated as agency executive officer and/or from acting as one.

d) For a period of 24 months following his licence issuance, the applicant shall enter into and maintain a written agreement with the agency within which he carries on his activities to the effect that the latter holds in trust the GST and QST payable to him, as real estate broker, until he is required to remit them along with his tax return.

e) For a period of 24 months following his licence issuance, the applicant shall enter into and maintain a written agreement with the agency within which he carries on his activities to the effect that the latter holds in trust a percentage of his compensation to pay his taxes. The percentage will have to be agreed upon between the agency and the applicant.

f) A copy of the agreement mentioned in paragraphs d) and e) shall be sent to the OACIQ Registry Service within thirty (30) days of the applicant’s licence issuance.

g) In the event of any agency change during the period mentioned in paragraphs d) and e), he must enter into an agreement under the same conditions with the new agency and send a copy thereof to the Organization’s Registry Service within 30 days following the agency change.

h) The period referred to in paragraphs c), d) and e) shall be suspended in the event the applicant suspends or revokes his real estate broker's licence.

i) The period referred to in paragraphs c), d) and e) shall end when the applicant accumulates 24 months as an active real estate broker’s licence holder;

Should the holder fail to comply with the above conditions and restrictions, his right to engage in real estate brokerage activities shall be suspended until he does so.

This notice became enforceable on May 17, 2022.

This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences.
