NOTICE OF IMPOSITION OF CONDITIONS AND RESTRICTIONS
ON KHALED ALIWI’S LICENCE

NOTICE is hereby given that Khaled Aliwi, residential real estate broker, licence number H9361, whose establishment is located in Laval has had conditions and restrictions imposed on his licence following a decision by the Licence Issue and Maintenance Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ), pursuant to section 37 (2) of the Real Estate Brokerage Act.

On August 18, 2022, the Licence Issue and Maintenance Committee imposed the following conditions and restrictions on Mr. Aliwi’s licence:

That it is appropriate to issue a licence to the applicant with the following conditions and restrictions:

a) For a period of 40 months following his licence issuance, prohibiting him from carrying on activities on his own account and from being designated as agency executive officer and/or from acting as one.

b) For a period of 40 months following his licence issuance, the applicant shall enter into and maintain a written agreement with the agency within which he carries on his activities to the effect that the latter holds in trust the GST and QST payable to him, as real estate broker, until he is required to remit them along with his tax return.

c) For a period of 40 months following his licence issuance, the applicant shall enter into and maintain a written agreement with the agency within which he carries on his activities to the effect that the latter holds in trust a percentage of his remuneration to pay his taxes. The percentage shall be agreed upon between the applicant and his agency.

d) A copy of the agreement mentioned in paragraphs b) and c) shall be sent to the OACIQ Registry Service within thirty (30) days of his licence issuance.

e) In the event of any agency change during the period mentioned in paragraphs b) and c), the applicant must enter into an agreement under the same conditions with the new agency and send a copy thereof to the Organization’s Registry Service within 30 days following the agency change.

f) The period referred to in paragraphs a), b) and c) shall be suspended in the event the applicant suspends or revokes his real estate broker's licence.

g) The period referred to in paragraphs a), b) and c) shall end when the applicant accumulates 40 months as an active real estate broker’s licence holder as of his licence issuance.  

Should the applicant fail to comply with the above conditions and restrictions, his right to engage in real estate brokerage activities shall be suspended until he does so.

This notice became enforceable on September 15, 2022.

This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences.
