NOTICE OF IMPOSITION OF RESTRICTIONS OR CONDITIONS ON A LICENCE
NOTICE is hereby given that Mr. Nicolas Tetrault, broker (licence D4139), whose establishment is located in St-Laurent, had restrictions and conditions imposed on his licence following a decision by the Licence Issue and Maintenance Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ), pursuant to section 38 (2) of the Real Estate Brokerage Act (CQLR, c. C-73.2).
Following its session of June 14, 2017, the Licence Issue and Maintenance Committee imposed the following restrictions on Mr. Nicolas Tetrault’s licence, until he is discharged from his bankruptcy:
He is prohibited from acting on his own account and/or as agency executive officer;
He cannot manage a trust account;
His practice shall be overseen and supervised by the executive officer of the agency he is acting for, in the same manner as for a beginner broker. And he must send an agreement with the agency executive officer, in which the latter undertakes to enforce this measure, no later than August 23, 2017, if he is an OACIQ licence holder or, if not, whenever he becomes a licence holder again.
Should he change agency, he must send a new agreement to the OACIQ Registry, in which the agency executive officer undertakes to enforce the above-mentioned measure, within 30 days following the agency change;
The following condition was also imposed:
To be able to lift the restrictions imposed on his licence, he must send to the OACIQ Registry a copy of his certificate of discharge or any other document proving that he is discharged from bankruptcy, in addition to meeting other requirements set out in the Real Estate Brokerage Act and its regulations.
If Mr. Nicolas Tetrault fails to provide the agreement with his agency executive officer within the specified period, his licence will be suspended until such time as he complies.
This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences (R.R.Q., c. C-73.2, r. 3).
