NOTICE OF SUSPENSION AND IMPOSITION OF RESTRICTIONS AND
CONDITIONS ON KIM TREMBLAY’S LICENCE

NOTICE is hereby given that Kim Tremblay, real estate broker (licence D9550) has had her licence suspended, in accordance with the decision of the Licence Issue and Maintenance Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ), rendered on February 14, 2018, pursuant to section 38 (3) of the Real Estate Brokerage Act (CQLR, c. C-73.2).

In accordance with section 39 of the Real Estate Brokerage Act, this decision remains valid, as the case may be:

 1° until the syndic or assistant syndic decides not to file a complaint; or

 2° until the discipline committee renders a final and enforceable decision on a complaint filed by the syndic or assistant syndic.

The Licence Issue and Maintenance Committee has also imposed the following conditions and restrictions on Kim Tremblay’s licence, which will be enforceable from the time she obtains the lifting of her licence suspension and until she is discharged from bankruptcy:

a) She is prohibited from acting on her own account and being designated and/or acting as an agency executive officer;

b) She cannot collect and administer all the taxes related to the sale of immovables by herself;

c) She shall enter into a written agreement with her agency, providing for the manner in which these taxes will be consistently managed and remitted to tax authorities and send a copy of this agreement to the OACIQ Registry within a maximum period of 30 days following the lifting of her licence suspension;

d) In the event of any agency change, she shall enter into an agreement according to the same conditions with the new agency and send a copy of this agreement to the OACIQ Registry within 30 days following the agency change;

e) To be able to lift the conditions and restrictions imposed in points a) to d), she must send to the OACIQ Registry her certificate of discharge or any other document proving that she is discharged from bankruptcy, in addition to meeting other requirements set out in the Real Estate Brokerage Act and its regulations.

This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences (R.R.Q., c. C-73.2, r. 3).

The decision is enforceable as of April 6, 2018.
