NOTICE OF IMPOSITION OF RESTRICTIONS OR CONDITIONS
ON RACHEL BERGERON’S LICENCE
NOTICE is hereby given that Rachel Bergeron, real estate broker (licence C3401), whose establishment is located in Saint-Hubert, has had conditions imposed on her licence, following a decision by the Licence Issue and Maintenance Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ), pursuant to section 38 (3) of the Real Estate Brokerage Act (CQLR, c. C-73.2).
On June 14, 2018, the Licence Issue and Maintenance Committee imposed the following conditions on Rachel Bergeron’s licence:
a) She must complete, within a 6-month period following the notification of this decision, the training entitled “The broker as a self-employed worker”, provided by the OACIQ Continuing Education Department or any other equivalent training accredited by the OACIQ, in addition to courses that she must take to meet her continuing education obligations.
b) Until she is discharged from bankruptcy, she shall enter into and maintain a written agreement with the agency within which she carries on her activities to the effect that the latter shall hold in trust the GST and QST payable to her, as real estate broker, until such time as she is required to remit them along with her tax return.
c) A copy of this agreement shall be sent to the OACIQ Registry, within 30 days following the notification of this decision;
d) In the event of any agency change during the period mentioned in item b), she must enter into an agreement according to the same conditions with the new agency and send a copy of it to the OACIQ Registry, within 30 days following the agency change;
e) She must send her certificate of discharge or any other document proving that she is discharged from bankruptcy to the OACIQ Registry, as soon as she receives it.
If Rachel Bergeron fails to comply with the conditions imposed, her right to engage in professional real estate brokerage activities will be suspended until she meets these requirements.
This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences (R.R.Q., c. C-73.2, r. 3).
