NOTICE OF IMPOSITION OF CONDITIONS AND RESTRICTIONS
ON KYRIA AUGER’S LICENCE

NOTICE is hereby given that Kyria Auger, real estate broker (licence D2215), whose establishment is located in Montreal, has had conditions and restrictions imposed on her licence, following a decision by the Licence Issue and Maintenance Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ), pursuant to section 38 (2°) of the Real Estate Brokerage Act (CQLR, c. C-73.2).

On May 5, 2021, the Licence Issue and Maintenance Committee imposed the following conditions and restrictions on Ms. Auger’s licence:

That it is appropriate to maintain Ms. Kyria Auger’s licence and impose the following conditions:

a) She must complete, within a 6-month period following the notification of this decision, the training entitled “The broker as a self-employed worker”, provided by the OACIQ Continuing Education Department or any other equivalent training accredited by the OACIQ, in addition to courses that she must take to meet her continuing education obligations;

b) She must provide proof of filing and payment of her GST/QST returns for 2020 and the first quarter of 2021 to the Organization's Registry Service, no later than June 30, 2021;

c) For a period of three years following the notification of this decision, she shall enter into and maintain a written agreement with the agency within which she carries on her activities to the effect that the latter holds in trust the GST and QST payable to her, as real estate broker, until she is required to remit them along with her tax return;

d) A copy of this agreement shall be sent to the Organization Registry Service within thirty (30) days following the notification of this decision;

e) In the event of any agency change during the period mentioned in item c), she must enter into an agreement under the same conditions with the new agency and send a copy thereof to the OACIQ Registry Service within 30 days following the agency change;

If Ms. Auger fails to comply with the conditions and restrictions imposed, her right to engage in real estate brokerage activities shall be suspended until she does so.

This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences (R.R.Q., c. C-73.2, r. 3).

The decision became enforceable on June  8, 2021.
