NOTICE OF IMPOSITION OF CONDITIONS AND RESTRICTIONS
ON MANON LEDUC’S LICENCE

NOTICE is hereby given that Manon Leduc, full-service real estate broker (licence C9710), whose establishment is located in Laval, has had conditions and restrictions imposed on her licence, following a decision by the Licence Issue and Maintenance Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ), pursuant to section 38 (2°) of the Real Estate Brokerage Act.

On March 3, 2022, the Licence Issue and Maintenance Committee imposed the following conditions and restrictions on Ms. Leduc’s licence:

a) Within six months following the notification of this decision, she shall complete the training course entitled “The broker as a self-employed worker,” provided by the OACIQ Continuing Education Department or any other equivalent training accredited by the OACIQ, in addition to training courses she must take to meet her continuing education obligations.

b) For a period of 36 months following the notification of this decision, prohibiting her from carrying on activities on her own account and from being designated as agency executive officer and/or from acting as one.

c) During a period of 36 months following the notification of this decision, she shall enter into and maintain a written agreement with the agency within which she carries on her activities to the effect that the latter holds in trust the GST and QST payable to her, as real estate broker, until she is required to remit them along with her tax return.

d) For a period of 36 months following the notification of this decision, she shall enter into and maintain a written agreement with the agency within which she carries on her professional activities to the effect that the latter holds in trust a percentage of her compensation to pay her taxes. The percentage will have to be agreed upon between the agency and the licensee to pay her instalments. The agency will remit the sums to the holder to pay the instalments on time.

e) A copy of the agreement mentioned in paragraphs c) and d) shall be sent to the OACIQ Registry Service within thirty (30) days following the notification of this decision.

f) In the event of any agency change during the period mentioned in paragraphs c) and d), she must enter into an agreement under the same conditions with the new agency and send a copy thereof to the Organization’s Registry Service within 30 days following the agency change.

g) The period referred to in paragraphs b) c) and d) shall end when the holder accumulates 36 months as an active real estate broker’s licence holder as of the notification of this decision.

h) The period referred to in paragraphs b) c) and d) shall be suspended in the event the holder suspends or revokes her real estate broker's licence.

If Ms. Leduc fails to comply with the conditions and restrictions imposed, her right to engage in real estate brokerage activities shall be suspended until she does so.

This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences.

The decision became enforceable on March 31, 2022.
