NOTICE OF IMPOSITION OF CONDITIONS AND RESTRICTIONS
ON ALAIN LECLERC’S LICENCE

NOTICE is hereby given that Alain Leclerc, full-service real estate broker (licence E1475), whose establishment is located in Trois-Rivières, has had conditions and restrictions imposed on his licence, following a decision by the Licence Issue and Maintenance Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ), pursuant to section 38 (2°) of the Real Estate Brokerage Act (CQLR, c. C-73.2).

On October 20, 2021, the Licence Issue and Maintenance Committee imposed the following conditions and restrictions on Mr. Leclerc:

That Mr. Alain Leclerc’s licence should be maintained with the following conditions and restrictions:

a) For a period of three (3) years following the notification of this decision, he shall enter into and maintain a written agreement with the agency within which he carries on his activities to the effect that the latter holds in trust the GST and QST payable to him, as a real estate broker, until he is required to remit them along with his tax return;

b) For a period of three (3) years following the notification of this decision, he shall enter into and maintain a written agreement with the agency within which he carries on his activities to the effect that the latter holds in trust a percentage of compensation payable to him, as a real estate broker, until he is required to remit it for his instalment payments. This percentage must be a minimum of 30%;

c) A copy of the agreement containing the terms referred to in item a) and b) shall be sent to the Organization’s Registry Service within thirty (30) days following the notification of this decision;

d) In the event of any agency change during the period mentioned in item a) and b), he must enter into an agreement under the same conditions with the new agency and send a copy of this agreement to the Organization’s Registry Service within thirty (30) days following the agency change;

e) For a period of three (3) years following the notification of this decision, prohibiting him from carrying on activities on his own account and from being designated and/or from acting as agency executive officer.

f) Within four months following notification of this decision, he shall complete the training course entitled “The broker as a self-employed worker,” provided by the OACIQ Continuing Education Department or any other equivalent training accredited by the OACIQ, in addition to courses he must take to meet his continuing education obligations.

g) He shall send his certificate of discharge from bankruptcy within 15 days of his discharge.

Should Mr. Alain Leclerc fail to comply with the above conditions and restrictions, his right to engage in real estate brokerage activities shall be suspended until he does so.

If Mr. Alain Leclerc is not discharged from bankruptcy in August 2022, his right to engage in real estate brokerage activities shall be suspended until a new decision is made by the Committee.

This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences (R.R.Q., c. C-73.2, r. 3).

The decision became enforceable on December 6 2021.
