NOTICE OF IMPOSITION OF CONDITIONS AND RESTRICTIONS
ON TONY KHOURY’S LICENCE

NOTICE is hereby given that Tony Khoury, real estate broker, licence D5085, whose establishment is located in Montreal, has had conditions and restrictions imposed on his licence, following a decision by the Licence Issue and Maintenance Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ), pursuant to section 38 ((2) of the Real Estate Brokerage Act.

On November 24, 2022, the Licence Issue and Maintenance Committee imposed the following conditions and restrictions on Mr. Khoury’s licence:

That it is appropriate to maintain Mr. Khoury’s licence and impose the following conditions and restrictions:

a. Within six (6) months of notification of this decision, he must complete the training course entitled “The broker as a self-employed worker,” provided by the OACIQ Continuing Education Department or any equivalent training accredited by the OACIQ.

b. Within 30 days of notification of this decision, the licensee shall send the OACIQ Registry Service proof of his registration for the training mentioned in paragraph a).

c. As of the notification of this decision until 24 months following his discharge from bankruptcy, prohibiting him from carrying on activities on his own account and from being designated as agency executive officer and/or from acting as one.

d. As of the notification of this decision until 24 months following his discharge from bankruptcy, the licensee shall enter into and maintain a written agreement with the agency within which he carries on his activities to the effect that the latter holds in trust the GST and QST payable to him, as a real estate broker, until he is required to remit them along with his tax return.

e. A copy of the agreement mentioned in paragraph d) shall be sent to the OACIQ Registry Service within thirty (30) days of the notification of this decision.

f. In the event of any agency change during the period mentioned in paragraph d), the licensee must enter into an agreement under the same conditions with the new agency and send a copy thereof to the Organization’s Registry Service within 30 days following the agency change.

g. The licensee shall forward any documents filed in his bankruptcy record to the Organization's Registry Service no later than 30 days following the date of filing, including his certificate of discharge.

h. The licensee shall send proof of payment or agreement with tax authorities for the refund of the amounts due as taxes for 2021, no later than 90 days following the notification of this decision. 

i. Should the licensee not be discharged from his bankruptcy by November 30, 2024, his file will be resubmitted to the Committee.

Should Mr. Khoury fail to comply with the above conditions and restrictions, his right to engage in professional real estate brokerage activities shall be suspended until he does so.

This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences.

The decision became enforceable on December 15, 2022.
