NOTICE OF IMPOSITION OF CONDITIONS AND RESTRICTIONS
ON IFTEKAR AL’S LICENCE

NOTICE is hereby given that Iftekar Al, real estate broker, licence G0541, whose establishment is located in Montreal, has had conditions and restrictions imposed on his licence, following a decision by the Licence Issue and Maintenance Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ), pursuant to section 38 (2) of the Real Estate Brokerage Act.
On June 23, 2022, the Licence Issue and Maintenance Committee imposed the following conditions and restrictions on Mr. Al’s licence:
- Within six months following notification of this decision, in addition to any training activities required to meet his continuing education obligations, the licence holder shall complete the training course entitled “The broker as a self-employed worker” provided by the OACIQ Continuing Education Department, or any other OACIQ-accredited training deemed equivalent.
- Within 30 days following notification of this decision, the licence holder shall send to the OACIQ Registry Service proof of his registration for the training mentioned in paragraph a).
- For a period of 12 months following notification of this decision, the licence holder shall be prohibited from carrying on activities on his own account or from being designated and/or acting as agency executive officer.
- For a period of 12 months following notification of this decision, the licence holder shall enter into and maintain a written agreement with the agency on behalf of which he carries on his professional activities, to the effect that the latter shall hold in trust the GST/QST payable to him, as real estate broker, until he is required to remit these taxes together with his return.
- For a period of 12 months following notification of this decision, the licence holder shall enter into and maintain a written agreement with the agency on behalf of which he carries on his professional activities, to the effect that the latter shall hold in trust a percentage of his remuneration in order to pay his income taxes. The percentage shall be agreed upon between the licence holder and his agency and provide for the payment of instalments.
- A copy of the agreement mentioned in paragraphs d) and e) shall be sent to the OACIQ Registry Service within 30 days following notification of this decision.
- In the event of an agency change during the period mentioned in paragraphs d) and e), the licence holder shall enter into an agreement under the same conditions with the new agency, and send a copy thereof to the Organization’s Registry Service within 30 days following the change.
- The period referred to in paragraphs c), d) and e) shall be suspended in the event the licence holder suspends or revokes his real estate broker's licence.
- The period referred to in paragraphs c), d) and e) shall end when the licence holder has completed 12 months as an active real estate broker licence holder following notification of this decision.
Should Mr. Al fail to comply with the above conditions and restrictions, his right to engage in professional real estate brokerage activities shall be suspended until he does so.
This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences.
This notice became enforceable on July 25, 2022.
