NOTICE is hereby given that Mr. Gyorgy Szabo, chartered real estate agent (Certificate No. B1479), formerly employed by or authorized to act on behalf of Royal LePage du Cartier, chartered real estate broker (Certificate No. C7674), whose establishment is located at 6322 Jean-Talon St. East, in Montreal, has been found guilty by the Discipline Committee of the Association des courtiers et agents immobiliers du Québec of the offence summarized below:

1st count: Beginning on February 18, 2002, with respect to an immovable, failing to show integrity, committing acts that are derogatory to the honour and dignity of the profession and participating in acts or practices in real estate matters which may be illegal or which may cause prejudice to the public or to the profession, namely by:

a) drafting and having sellers sign a counter-proposal, whereas it falsely stated “Le vendeur s’engage à signer un bail pour douze mois à partir de 01/07/2002 jusqu’au 30-06-2003 pour un montant de 1 500 $ par mois, non chauffé, non éclairé”(sic) (The seller agrees to sign a lease for twelve months from 01/07/2002 to 30/06/2003 for an amount of $1,500 per month, not including heat or lighting);

b) by drafting and having sellers sign a counter-proposal whereas it included point 4 contained in a counter-proposal, which falsely stated “Le vendeur s’engage à signer un bail pour douze mois à partir de 01/07/2002 jusqu’au 30-06-2003 pour un montant de 1 500 $ par mois, non chauffé, non éclairé”(sic) (The seller agrees to sign a lease for twelve months from 01/07/2002 to 30/06/2003 for an amount of $1,500 per month, not including heat or lighting);

whereas the sole purpose of this so-called commitment on the part of the sellers was to allow the buyers to obtain a mortgage and actually did lead to the granting of a mortgage based on this false information, the whole contrary to sections 1 and 13 of the Rules of Professional Ethics of the ACAIQ.

On September 11, 2008, the Discipline Committee ordered a suspension of Mr. Gyorgy Szabo’s certificate for a period of forty-five (45) days on this count of the complaint.

The decision of the Discipline Committee is enforceable from the date of the appeals deadline, i.e. January 13, 2009. The suspension of Mr. Gyorgy Szabo’s chartered real estate agent’s certificate is therefore effective as of January 13, 2009 for a period of forty-five (45) days.

Should the defendant’s certificate be suspended or expired at the date of the appeals deadline, the restriction on applying for reinstatement or issuance of any category of certificate, for the above period, shall become effective whenever he applies for reinstatement or issuance of any category of certificate.

This notice is given in accordance with section 137 of the Real Estate Brokerage Act (R.S.Q., c. C-73.1).
