NOTICE is hereby given that Mr. Yahya Ahmadou Ba, affiliated real estate agent (Certificate No. D5851), formerly employed by or authorized to act on behalf of Hypotheca Courtier Hypothécaire AC, chartered real estate broker (Certificate No. A3323), whose establishment is located at 2272 Fleury St. E., in Montréal, has been found guilty by the Discipline Committee of the Association des courtiers et agents immobiliers du Québec notably of the offence summarized below:

1st count: During the months of February and March 2005, failing to avoid a situation which could place him in a conflict of interest, failing to show integrity, committing acts that are derogatory to the honour and dignity of the profession, and participating in acts or practices in real estate matters which may be illegal or which may cause prejudice to the public or to the profession, namely by:

a) trying to get a promising buyer to purchase immovables owned by the defendant;

c) sending an incomplete file regarding the financing of the acquisition of an immovable by a promising buyer;

the whole contrary to sections 1, 5, 13 and 29 of the Rules of Professional Ethics of the ACAIQ.

On April 9, 2009, the Discipline Committee ordered a suspension of Mr. Yahya Ahmadou Ba’s certificate for a period of fifteen (15) months on count No. 1 a) of the complaint, and a suspension for a consecutive period of nine (9) months on count No. 1 c) of the complaint.

The decision of the discipline Committee is enforceable from the date of the appeals deadline, i.e. May 29, 2009. The suspension of Mr. Yahya Ahmadou Ba’s affiliated real estate agent’s certificate is therefore effective as of May 29, 2009 for a period of twenty-four (24) months.

Should the defendant’s certificate be suspended or expired at the date of the appeals deadlines, the restriction from applying for reinstatement or issuance of any category of certificate shall become effective at the time of such application.

This notice is given in accordance with section 137 of the Real Estate Brokerage Act (R.S.Q., c. C-73.1).
