of Mr. Michel Warren

NOTICE is hereby given that Mr. Michel Warren, affiliated real estate agent (certificate No. B5926), formerly employed by or authorized to act on behalf of La Bonne Adresse, chartered real estate broker (Certificate No. D5600), whose establishment is located at 8646 Hochelaga St. in Montréal, has been found guilty by the Discipline Committee of the Association des courtiers et agents immobiliers du Québec of the offences summarized below:

1st count: Between October 2002 and March 2003, failing to demonstrate integrity, committing an act that is derogatory to the honour and dignity of the profession, agreeing to and participating in acts or practices in real estate matters which may be illegal or which may cause prejudice to the public or to the profession:

namely by providing, for the purpose of financing the purchase of three immovables, promises to purchase and documents containing false information;

the whole contrary to sections 1, 13 and 35 of the Rules of Professional Ethics of the ACAIQ.

2nd count: On or around May 23, 2002, failing to show integrity, committing an act that is derogatory to the honour and dignity of the profession, participating in an act or practice in real estate matters which may be illegal or which may cause prejudice to the public or to the profession:

namely by falsely attesting to the signature of a seller designated in a promise to purchase concerning an immovable;

the whole contrary to sections 1 and 13 of the Rules of Professional Ethics of the ACAIQ.

3rd count: On or around April 22, 2006 and on or around March 9, 2007, hindering the work of an assistant syndic, failing to collaborate during an inquiry conducted by him and misrepresenting information, namely:

a) on or around April 22, 2006, by stating that he knew nothing about the use of the expression “M.W. Michael” and concealing what he knew about the use of it by a third party;

b) on or around March 9, 2007, by stating that he thought he was the author of the handwritten additions to a promise to purchase concerning an immovable;

c) on or around March 9, 2007, by stating that the seller designated in this promise to purchase had signed the promise in the defendant’s presence;

the whole contrary to sections 117 and 127 of the Real Estate Brokerage Act and sections 54 and 55 of the Rules of Professional Ethics of the ACAIQ.

On October 20, 2008, the Discipline Committee ordered a suspension of Mr. Michel Warren’s certificate for a period of twelve (12) years on count No. 1 of the complaint, a suspension for a period of ninety (90) days on count No. 2, and a suspension for a period of six (6) months on count No. 3, to be served consecutively.

The decision of the Discipline Committee is enforceable notwithstanding appeal. The suspension of Mr. Michel Warren’s affiliated real estate agent’s certificate is therefore effective as of October 23, 2008 for a period of 12 years, 6 months and 90 days. Should the defendant’s certificate be suspended or expired at the date of the appeals deadline, the above restrictions shall become effective whenever he applies for reinstatement or issuance of any category of certificate.

This notice is given in accordance with section 137 of the Real Estate Brokerage Act (R.S.Q., c. C-73.1).
