NOTICE is hereby given that Mr. Yanick Laurin, affiliated real estate agent (Certificate No. D3669), formerly employed by or authorized to act on behalf of L'Expert Immobilier P.M. Enr, chartered real estate broker (Certificate No. A2312), whose establishment is located at 1453 Beaubien St. E., Suite 201, in Montréal, has been found guilty by the Discipline Committee of the Association des courtiers et agents immobiliers du Québec notably of the offence summarized below:

3rd count: With respect to an immovable, whereas he had signed an Annex AG to the effect that a sum of five thousand dollars would be taken from the selling price of the immovable and held by the notary acting in the sale until completion of the work indicated on this Annex:

a) in June 2004, at the signing of the act of sale, threatening not to sign this act unless the buyer gave instructions to the notary to release said sum of five thousand dollars, this despite the fact that the work in question had not been completed;

b) during the months of July and August 2004, putting pressure on the buyer to instruct the notary to release a portion of said sum of five thousand dollars, this despite the fact that the work in question had not been completed;

thus committing, for each of the above paragraphs, an offence under sections 1 and 13 of the Rules of Professional Ethics of the ACAIQ.

On April 21, 2009, the Discipline Committee ordered a suspension Mr. Yanick Laurin’s certificate for a period fo sixty (60) days on count No. 3 a) of the complaint, and a suspension for a concurrent period of sixty (60) days on count No. 3 b).

The decision of Discipline Committee is enforceable from the date of the appeals deadline, i.e. May 28, 2009. The suspension of Mr. Yanick Laurin’s affiliated real estate agent’s certificate is therefore effective as of May 28, 2009 for a period of sixty (60) days.

Should the defendant’s certificate be suspended or expired at the date of the appeals deadline, the above suspensions shall become effective whenever he applies for reinstatement or issuance of any category of certificate.

This notice is given in accordance with section 137 of the Real Estate Brokerage Act (R.S.Q., c. C-73.1).
