NOTICE OF SUSPENSION OF
MR. RACHID BERKANE’S LICENCE
NOTICE is hereby given that Rachid Berkane, former real estate broker (Licence No. E3006), whose establishment was located in Montréal, has been found guilty by the Discipline Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ) of the offence summarized below:
1st count: Between on or around the months of September and December 2007, in the course of steps taken to obtain a financing secured by immovable hypothec for the acquisition of immovables, sent or allowed to be sent to financial institutions false documents and/or inaccurate information in support of seven financing applications secured by immovable hypothecs and failing or neglecting to confirm their legitimacy with the buyers concerned or with the alleged issuers of documents, while he had obtained these documents and information from an individual other than the buyers concerned, who was not an ACAIQ member.
2nd count: Between on or around the months of September and December 2007, in the course of steps taken to obtain a financing secured by immovable hypothec for six buyers, caused or allowed an individual other than the buyers to sign as a borrower the “Exclusive brokerage contract” relating to these six immovables.
On January 27, 2015, the Discipline Committee ordered the permanent suspension of Rachid Berkane’s real estate broker’s licence on counts No. 1a) to 1g) and 2a) to 2f) of the complaint.
Given that Rachid Berkane is no longer a licence holder, his licence will be suspended permanently whenever he becomes a licence holder again.
This notice is given in accordance with section 98.1 of the Real Estate Brokerage Act (R.S.Q., c. C-73.2) and section 33 of the Regulation respecting the issue of broker’s and agency licences (R.R.Q., c. C-73.2, r.3).
