NOTICE OF SUSPENSION
OF THE LICENCE OF MR. JEAN MEDICA BELLEUS

NOTICE is hereby given that Mr. Jean Medica Belleus, formerly real estate broker (Licence No. D7243), whose establishment was located in Montréal, has been found guilty by the Discipline Committee of the Organisme d’autoréglementation du courtage immobilier du Québec notably of the offences summarized below:

3rd count: On or around February 13, 2007, concerning an immovable, asking that an amount of $7,500.00 be deposited in his spouse's account and an amount of $1,000.00 be paid to him, the whole corresponding to the sum of $8,500.00 to serve as a deposit on the promise to purchase of the promising buyer;

thus violating section 11 of the Real Estate Brokerage Act.

4th count: On or around March 1, 2007, in support of a mortgage application concerning an immovable, sending or allowing the sending to a financial institution of a "donation letter" supposedly signed by a third party on behalf of his spouse whereas he knew or should have known that the document was false;

the whole contrary to section 13 of the Rules of Professional Ethics of the ACAIQ.

5th count: Concerning an immovable, failing to honour the commitment made to the promising buyer to repay in full the sum of $8,500.00 that she had given him as deposit before June 22, 2007;

the whole contrary to section 13 of the Rules of Professional Ethics of the ACAIQ.

On March 28, 2012, the Discipline Committee ordered a suspension of Mr. Jean Medica Belleus’ real estate broker’s licence for a period of three (3) months on count No. 3 a) of the complaint, a suspension for a period of two (2) months on count No. 4, and a suspension for a period of two (2) months on count No. 5, to be served consecutively as of the date of the appeals deadline if the defendant is the holder of a licence issued by the OACIQ or, if not, whenever he becomes a licence holder again.

Given that Mr. Jean Medica Belleus is no longer the holder of a licence, his licence shall be suspended for a period of seven (7) months whenever he becomes a licence holder again.

This notice is given in accordance with section 98.1 of the Real Estate Brokerage Act (R.S.Q., c. C-73.2) and section 33 of the Regulation respecting the issue of broker’s and agency licences (R.R.Q., c. C-73.2, r.3).
