NOTICE is hereby given that Mrs. Nathalie Provost, affiliated real estate agent (Certificate No. C8007), formerly employed by or authorized to act on behalf of Proprio Direct inc., chartered real estate broker (Certificate No. A3180), whose establishment is located at 3899 Autoroute des Laurentides, Suite 200 in Laval, has been found guilty by the Discipline Committee of the Association des courtiers et agents immobiliers du Québec of the offence summarized below:

1st count: On or around October 16 and 17, 2002, with respect to an immovable, failing to demonstrate integrity and a spirit of cooperation, committing acts that are derogatory to the honour and dignity of the profession, failing to advise and inform with objectivity and to protect and promote the interests of her selling clients, notably by taking the actions and making the representations described hereunder, acting in a manner that did not promote higher bidding to the benefit of her selling clients, where two buying couples were interested in the said immovable concomitantly, and/or that prevented the possibility of having to share her compensation with another real estate agent, notably by:

a) providing indications to the promising buyers whom she represented as to a portion of the content, i.e. namely the offering price of the other promising buyers represented by other real estate agents;

b) failing to draft, without delay, a promise to purchase for the promising buyers she was representing and who had expressed their intention to sign such a promise on the evening of October 16, 2002, only drafting it after the other real estate agents representing the other promising buyers had been notified of the sellers’ refusal of a counter-proposal;

c) letting the sellers refuse a counter-proposal from the other promising buyers represented by other real estate agents on the faith of her representations to the effect that she was going to draft for promising buyers whom she represented a promise to purchase for a price equal to or greater than that of the said counter-proposal;

the whole contrary to sections 1, 13, 24, 26, 40 and 43 of the Rules of Professional Ethics of the ACAIQ.

On October 12, 2005, the Discipline Committee ordered the suspension of Mrs Nathalie Provost’s certificate for a period of thirty (30) days, to take effect whenever she applies for reinstatement of her certificate or the issuance of a new certificate.

The decision of the Discipline Committee is executory from the date of the appeals deadline, i.e. November 14, 2005. The suspension of Mrs. Nathalie Provost’s affiliated real estate agent certificate will therefore become effective whenever she applies for reinstatement of her certificate or the issuance of a new certificate, for a period of thirty (30) days.

This notice is given in accordance with section 137 of the Real Estate Brokerage Act (R.S.Q., c. C-73.1).
