of Mr. Mario Paquin

NOTICE is hereby given that Mr. Mario Paquin, formerly the holder of a chartered real estate broker certificate (Certificate No. A2296), whose establishment was located at 235, chemin de la Grande Côte in Rosemère, has notably been found guilty by the Discipline Committee of the Association des courtiers et agents immobiliers du Québec of the offence summarized below:

2nd count: Between on or around March 1, 2004 and on or around April 8, 2004, with respect to an immovable, committing acts that are derogatory to the honour and dignity of the profession, participating in acts or a practice in real estate matters which may be illegal or which may cause prejudice to the public or to the profession, namely:

a) on or around April 7, 2004, by completing and having a promising buyer sign a notice of disclosure falsely stating having done “some work recently”;

b) on or around April 8, 2004, by completing and having a promising buyer sign a promise to purchase for a price of $150,000, notably:

i) without telling her that a few days prior, i.e. on or around March 28, 2004, the owner of the immovable had accepted to sell this immovable to him for a price of $89,300 pursuant to another promise to purchase;

ii) whereas she had not examined the inside of the immovable, by failing to put in writing in a promise to purchase the relevant facts and factors relating to the immovable liable to reduce the value thereof or reduce the income generated thereby, or to increase the expenses related thereto, including the fact that there had been a fire in the immovable, the water infiltration problems and the roof ventilation problems;

iii) without including a clause to the effect that a promise to purchase was conditional to his becoming the owner of this immovable;

the whole contrary to sections 1 and 13 of the Rules of Professional Ethics of the ACAIQ.

On February 20, 2007, the Discipline Committee ordered a suspension of Mr. Mario Paquin’s certificate for a period of thirty (30) days on this count of the complaint, to become effective whenever he applies for reinstatement or the issuance of a certificate in any category.

The decision of the Discipline Committee is enforceable from the date of the appeals deadline, i.e. April 12, 2007. The suspension of Mr. Mario Paquin’s chartered real estate broker certificate will therefore become effective whenever he applies for reinstatement or the issuance of a certificate in any category, for a period of thirty (30) days.

This notice is given in accordance with section 137 of the Real Estate Brokerage Act (R.S.Q., c. C-73.1).
