NOTICE is hereby given that Mr. Urgo Jean-Baptiste, affiliated real estate agent (Certificate No. B7927), formerly employed by or authorized to act on behalf of Les Immeubles Royal 3000 inc., chartered real estate broker (Certificate No. A2409), whose establishment is located at 12190, Laurentian Blvd. in Montreal, has notably been found guilty by the Discipline Committee of the Association des courtiers et agents immobiliers du Québec of the offences summarized below:

1st count: Starting on May 18, 2003, with respect to an immovable, committing an act that is derogatory to the honour and dignity of the profession and participating in an act or practice in real estate matters which may be illegal or which may cause prejudice to the public or to the profession, namely:
by creating a bond of trust with a promising buyer in order to get him to sign a promise to purchase, by luring him with the prospect that the purpose was the profitable resale of the said immovable, whereas he knew or could not have been unaware that the buyer was unemployed and did not have the financial means to make such an acquisition, and thereafter abusing his trust;
the whole contrary to sections 1 and 13 of the Rules of Professional Ethics of the ACAIQ.

2nd count: During the month of May 2003, participating in an act in real estate matters which may be illegal or which may cause prejudice to the public or to the profession, namely:
by providing documents, including an alleged confirmation of employment for a promising buyer, a statement for an account allegedly held by the said promising buyer with a banking institution, and an RRSP statement for an account allegedly held by the said promising buyer at another banking institution, for the purpose of applying for financing with a third banking institution as part of a real estate transaction regarding an immovable, whereas he knew or could not be unaware that these documents were forged;
the whole contrary to section 13 of the Rules of Professional Ethics of the ACAIQ.

3rd count: In June 2003, committing an act that is derogatory to the honour and dignity of the profession and participating in an act or practice in real estate matters which may be illegal or which may cause prejudice to the public or to the profession, namely:
by directly or indirectly appropriating a bank draft in the amount of $10,700 issued by the third banking institution and drawn on an account open in the name of the said promising buyer, and using the said bank draft to purchase a vehicle in the name of a third party;
the whole contrary to sections 1 and 13 of the Rules of Professional Ethics of the ACAIQ.

On April 23, 2007, the Discipline Committee ordered a suspension of Mr. Urgo Jean-Baptiste’s certificate for a period of four (4) years on counts Nos. 1 and 2 of the complaint, to be served concurrently, and a suspension for a period of three (3) years on count No. 3, to be served consecutively to the suspension on counts Nos. 1 and 2.

The decision of the Discipline Committee is enforceable from the date of the appeals deadline, i.e. July 31, 2007. The suspension of Mr. Urgo Jean-Baptiste’s affiliated real estate agent certificate will become effective whenever he applies for reinstatement of his certificate or the issuance of a new certificate, for a period of seven (7) years.

This notice is given in accordance with section 137 of the Real Estate Brokerage Act (R.S.Q., c. C-73.1).
