NOTICE is hereby given that Mr. Joël McKenzie, affiliated real estate agent (Certificate No. B6040), formerly employed by or authorized to act on behalf of Royal LePage Anne Shears C.B., chartered real estate broker (Certificate No. D2004), whose establishment is located at 3049D Deacon Street in Dollard-des-Ormeaux, has been found guilty by the Discipline Committee of the Association des courtiers et agents immobiliers du Québec of the offence summarized below:

1st count: At the end of May 2004, failing to demonstrate integrity while participating in an act or practice in real estate matters which may be illegal or which may cause prejudice to the public or to the profession, namely by taking arrangements directly with a vendor, in order to obtain the sum of eight thousand one hundred and sixty ($8,160.00) in cash money as compensation for the sale of an immovable, from a person other than the holder of a chartered real estate broker’s certificate that employs him or authorizes him to act on his behalf, the whole contrary to section 1 and 13 of the Rules of Professional Ethics of the ACAIQ and section 72 of the By-Law of the ACAIQ.

On January 7, 2009, the Discipline Committee ordered a suspension of Mr. Joël McKenzie’s certificate for a period of thirty (30) days on the count No. 1 of the complaint, as from defendant’s eventual application for its renewal or for the issuance of any category of certificate.

The decision of the Discipline Committee is enforceable from the date of the appeals deadline, i.e. February 10, 2009. The suspension of Mr. Joël McKenzie’s affiliated real estate agent certificate will be effective as from defendant’s eventual application for its renewal or for the issuance of any category of certificate, for a period of thirty (30) days.

This notice is given in accordance with section 137 of the Real Estate Brokerage Act (R.S.Q., c. C-73.1).
