of Mr. Sylvio René

NOTICE is hereby given that Mr. Sylvio René, affiliated real estate agent (Certificate No. D4907), formerly employed by or authorized to act on behalf of Mon 1er Services Immobiliers Inc, chartered real estate broker (Certificate No. D8043), whose establishment is located at 7042 Pie IX Blvd., in Montreal, has notably been found guilty by the Discipline Committee of the Association des courtiers et agents immobiliers du Québec of the offences summarized below:

2nd count: In May 2006, with respect to an immovable, sending to the representative of a financial institution a confirmation of employment letter and a salary record concerning a promising buyer, whereas he knew or should have known that these documents were false or included elements that had been altered;

the whole contrary to sections 1 and 13 of the Rules of Professional Ethics of the ACAIQ.

3rd count: Misrepresenting information when providing information or documents during an investigation conducted by an assistant syndic, namely by declaring:

a) on September 28, 2007, to an investigator: [tr.] “at no time did the promising buyer give me a confirmation of employment letter dated April 21, 2006 stating that he had an hourly salary of $10.10. I never saw that letter;”

b) on January 22, 2008, to the assistant syndic: [tr.] “The reason I said in my declaration of September 28, 2007 that the promising buyer did not give me a letter on April 21, 2006 is because he did not give me a letter stating an income of $10.10 an hour”;

the whole contrary to section 55 of the Rules of Professional Ethics of the ACAIQ.

On April 9, 2009, the Discipline Committee ordered a suspension of Mr. Sylvio René’s certificate for a period of sixty (60) days on count No. 2 of the complaint, a suspension for a period of sixty (60) days on count No. 3 a), and a suspension for a period of thirty (30) days on count No. 3 b), to be served consecutively.

The decision of the Discipline Committee is enforceable from the date of the appeals deadline, i.e. May 19, 2009. The suspension of Mr. Sylvio René’s affiliated real estate agent’s certificate is therefore effective as of May 19, 2009 for a period of one hundred and fifty (150) days.

Should the defendant’s certificate be suspended or expired at the date of the appeals deadline, the above suspensions shall become effective whenever he applies for reinstatement or issuance of any category of certificate.

This notice is given in accordance with section 137 of the Real Estate Brokerage Act (R.S.Q., c. C-73.1).
