NOTICE OF SUSPENSION OF
MR. PIERRE BÉDARD’S LICENCE

NOTICE is hereby given that Mr. Pierre Bédard, former real estate broker (licence No. C9592) whose establishment is located in Montréal, has been found guilty by the Discipline Committee of the Organisme d’autoréglementation du Courtage Immobilier du Québec of the offences summarized below:

2nd count: In 2004 and 2005, prior to signing the acts of sale concerning sixteen (16) immovables and to concomitant signing of related loans secured by immovable hypothecs, having omitted to inform the signatories that they were not assured of being released from the obligations arising from their loans in the event these immovables are resold, violating thus, on each of these occasions, section 13 of the Rules of Professional Ethics of the ACAIQ.

3rd count: During the month of January 2006, having sold to a promising buyer, the assets and the share capital of an enterprise operating a business, by falsely informing the promising buyer that the liquor licence displayed in this business could be used until he or she obtains his or her own licence, committing thus an offence under section 13 of the Rules of Professional Ethics of the ACAIQ.

4th count: On May 5, 2006, having organized the purchase of an immovable by his spouse, without the knowledge of the owner duly registered in Land Register, committing thus an offence under section 13 of the Rules of Professional Ethics of the ACAIQ.

5th count: In May and June 2006, ensuring that various persons become, without their knowledge, owners registered in Land Register of four (4) immovables, violating thus, on each of these occasions, section 13 of the Rules of Professional Ethics of the ACAIQ.

6th count: In August 2005, after terminating his relationship with a real estate agent, having intimidated and threatened the latter in order not to reveal his activities, committing thus an offence under section 13 of the Rules of Professional Ethics of the ACAIQ.

7th count: Between March 2006 and August 2007, following their differences regarding real estate matters, had a malicious and arrogant behaviour towards a party engaged in a real estate transaction, committing thus, against that person, an offence under section 13 of the Rules of Professional Ethics of the ACAIQ.

8th count: On or around July 2008, having impeded the work of the Syndic and failing to cooperate during the investigation conducted by the latter, notably by avoiding and refusing to answer the investigator’s various questions, committing thus an offence under section 117 of the Real Estate Brokerage Act.

On September 12, 2011, the Discipline Committee ordered a permanent suspension of Mr. Pierre Bédard’s licence, enforceable as of the date the penalty decision is served on the defendant if the latter is the holder of a licence issued by the OACIQ or, if not, whenever he becomes a licence holder again.

Given that Mr. Pierre Bédard does not hold any licence, his licence shall be suspended permanently whenever he becomes a licence holder again.

This notice is given in accordance with section 98.1 of the Real Estate Brokerage Act (R.S.Q., c. C-73.2) and section 33 of the Regulation respecting the issue of broker’s and agency licences.
