NOTICE OF SUSPENSION
OF MR. PAUL VALADE’S LICENCE

NOTICE is hereby given that Mr. Paul Valade, real estate broker (licence No. C7602) whose establishment is located in Brossard, has been found guilty by the Discipline Committee of the Organisme d’autoréglementation du courtage immobilier du Québec of the offences summarized below:

1st count: During the following periods, having favoured and acquiesced to growing cannabis in immovables:
a) between April and December 2004;
b) between June 2005 and February 2007;
c) between June 2007 and August 2008;
thus violating, on each occasion, section 13 of the Rules of Professional Ethics of the ACAIQ.

2nd count: During the years 2003 to 2007, having completed the following forms and failing to indicate that these immovables described in these forms have been used to grow cannabis despite the fact that he knew that, namely :
a) a brokerage contract and a promise to purchase concerning an immovable;
b) a brokerage contract concerning an immovable;
c) a promise to purchase concerning an immovable;
d) brokerage contracts and a promise to purchase concerning an immovable;
e) a promise to purchase concerning an immovable;
thus violating, regarding each form, section 13 of the Rules of Professional Ethics of the ACAIQ.

3rd count: Concerning an immovable, having written on the space provided for the signatures, the name of a promising buyer, in lieu thereof on the following documents:
a) On or around May 3, 2005, on a promise to purchase, an annex A and an annex B;
b) On or around July 8, 2007, on a promise to purchase, an annex A and an annex B;
thus committing, on each occasion, an offence under section 13 of the Rules of Professional Ethics of the ACAIQ.

4th count: On or around October 5, 2005, having obtained two loans secured by immovable hypothec on an immovable without first informing lenders that this immovable has been used to grow cannabis;
thus violating section 13 of the Rules of Professional Ethics of the ACAIQ.

6th count: On or around November 20, 2008, having made false declarations when he provided information during an investigation conducted by the Syndic, notably by declaring to the investigator, that when completing the following documents, he did not know that the immovables described in these documents have been used to grow cannabis:
a) a brokerage contract and a promise to purchase concerning an immovable;
b) a promise to purchase concerning an immovable;
thus committing, in each representation, an offence under section 55 of the Rules of Professional Ethics of the ACAIQ.

On May 10, 2011, the Discipline Committee ordered a permanent suspension of Mr. Paul Valade’s licence, enforceable as of the date of notification of the decision on penalty, and notwithstanding appeal, if the defendant is the holder of a licence issued by the OACIQ or, if not, whenever he becomes a licence holder again.

The permanent suspension of Mr. Paul Valade’s real estate broker’s licence takes effect as of May 16, 2011.

This notice is given in accordance with section 98.1 of the Real Estate Brokerage Act (R.S.Q., c. C-73.2) and section 33 of the Regulation respecting the issue of broker’s and agency licences.
