NOTICE OF SUSPENSION OF
MR. BERNARD MONDOU’S LICENCE

NOTICE is hereby given that Bernard Mondou, former real estate broker (Licence No. D0518), whose establishment was located in Montréal, has notably been found guilty by the Discipline Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ) of the offences summarized below:

1st count: At an unknown date, but must be around or about November 13, 2007, until on or around December 5, 2007, concerning an immovable, abused the seller’s and/or promising buyer’s trust by proposing that the seller temporarily sells him the said immovable, while suggesting that the promising buyer would then get the amount of $20,000, the whole contrary to section 13 of the Rules of Professional Ethics of the ACAIQ.

2nd count: On or around November 13, 2007, concerning an immovable:

a) Prepared and signed as a promising buyer and had the seller accept the document entitled “Promise to sell” indicating a price of $225,000 while this amount did not represent the real selling price agreed to between the parties;

b) Prepared and signed an annex to a promise to purchase an immovable between the seller and the buyer providing in particular: “[that] it is hereby understood and acknowledged that, at the signing of the deed of sale of the property referred to above, the seller will give the buyer the amount of $30,000 […]” [sic], while the “Promise to sell” signed by the parties did not contain any reference to said annex;

c) sent or had someone send to the mortgage lender the document entitled “Promise to sell” without ensuring that the said mortgage lender is informed of the existence of an annex to a promise to purchase between the seller and the buyer;

the whole contrary to section 13 of the Rules of Professional Ethics of the ACAIQ.

On February 6, 2015, the Discipline Committee ordered the suspension of Bernard Mondou’s real estate broker’s licence (Licence No. D0518) for a period of ninety (90) days on each of counts No. 1, 2 a), 2 b) and 2 c) of the formal complaint, to be served concurrently with each other.

Given that Bernard Mondou is no longer a licence holder, his licence will be suspended for a period of ninety (90) days whenever he becomes a licence holder again.

This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences (R.R.Q., c. C-73.2, r.3).
