NOTICE OF SUSPENSION
OF MR. BRUNO MASSON’S LICENCE

NOTICE is hereby given that Mr. Bruno Masson, former real estate broker (licence no. C8272) whose establishment was located in Saint-Jean-sur-Richelieu, has notably been found guilty by the Discipline Committee of the Organisme d’autoréglementation du Courtage Immobilier du Québec of the offences summarized below:

3rd count: As of or around January 26, 2009, concerning an immovable:

a) having drafted a promise to purchase on behalf of the buyer even though he has never met her;

b) failing to validate directly with the buyer that the drafting of the promise to purchase adequately reflected her will;

c) failing to ensure directly with the buyer that the signature on the promise to purchase was hers;

d) failing to ensure the acceptance by the buyer that the counter-proposal adequately reflected her will;

e) failing to ensure directly with the buyer that the signature on the counter-proposal was hers;

the whole contrary to section 11 of the Rules of Professional Ethics of the ACAIQ.

4th count: In the course of or around February 2009, in the process of obtaining a financing secured by immovable hypothec for the acquisition of an immovable by a promising buyer, having sent or allowed to be sent to a person, documents or information of which the content proved to be false (false documents or inaccurate information), whereas he did not obtain these documents or this information from the concerned buyer or neglected to have their legitimacy confirmed by the latter;

the whole contrary to section 11 of the Rules of Professional Ethics of the ACAIQ.

On September 7, 2011, the Discipline Committee ordered a suspension of Mr. Bruno Masson’s real estate broker’s licence (C8272) for concurrent periods of ninety (90) days on each of the counts no. 3 a), 3 b), 3 c), 3 d) and 3 e) of the complaint and a suspension for a consecutive period of ninety (90) on count no. 4. These suspension periods shall be served as of the date of the appeals deadline if the defendant is the holder of a licence issued by the OACIQ or, if not, whenever he becomes a licence holder again.

Given that Mr. Bruno Masson is not a licence holder, his licence will be suspended for a period of one hundred and eighty days (180) whenever he becomes a licence holder again.

This notice is given in accordance with section 98.1 of the Real Estate Brokerage Act (R.S.Q., c. C-73.2) and section 33 of the Regulation respecting the issue of broker’s and agency licences (R.R.Q., c. C-73.2, r.3).
