NOTICE OF SUSPENSION
OF THE LICENCE OF MRS. MONIQUE LAVOIE

NOTICE is hereby given that Mrs. Monique Lavoie, real estate broker (Licence No. E4357), whose establishment was located in Saint-Lin des Laurentides, has been found guilty by the Discipline Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ) notably of the offence summarized below:

2nd count: Concerning an immovable, allowing and/or making it easier for an individual to put in place a scheme allowing a supposed third party to receive a sum of money corresponding approximately to the difference between an initially agreed-to purchase price of $145,000 and a sale secured by immovable hypothec notarized at a price of $205,000, namely:

a) on or around January 19, 2009, by going to the immovable at the individual's request and by inviting on his own initiative a prospective buyer to visit the immovable, whereas she had not yet signed a brokerage contract with the supposed seller of the immovable;

b) on or around January 19, 2009, by a brokerage contract signed by an individual who presented himself under the buyer's name;

c) on or around January 19, 2009, by having an individual presenting himself under the buyer's name accept a promise to purchase from the prospective buyer;

d) on or around January 20, 2009, by making up and allowing the publication of a detailed description sheet of the immovable from information received from the individual, without verifying the veracity of the information;

the whole contrary to section 13 of the Rules of Professional Ethics of the ACAIQ.

On April 24, 2012, the Discipline Committee ordered a suspension of Mrs. Monique Lavoie's real estate broker’s licence for a period of six (6) months on count No. 2 of the complaint, to be served as of the date of the appeals deadline if the defendant is the holder of a licence issued by the OACIQ or, if not, whenever she becomes a licence holder again.

Given that Mrs. Monique Lavoie is not the holder of a licence, her licence shall be suspended for a period of six (6) months whenever she becomes a licence holder again.

This notice is given in accordance with section 98.1 of the Real Estate Brokerage Act (R.S.Q., c. C-73.2) and section 33 of the Regulation respecting the issue of broker’s and agency licences (R.R.Q., c. C-73.2, r.3).
