NOTICE OF SUSPENSION
OF MR. HOANG KHOI NGUYEN’S LICENCE

NOTICE is hereby given that Mr. Hoang Khoi Nguyen, real estate broker (licence no. D9482), whose establishment is located in Montréal, has been found guilty by the Discipline Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ) of the offences summarized below:

1st count: In the course of steps undertaken to obtain a financing secured by immovable hypothec for the acquisition of an immovable:

a) at an unknown date but probably between on or around May 13, 2008 and on or around August 6, 2008, participated in the fabrication of a federal Notice of Assessment for the year 2006 concerning the promising buyer;

b) at an unknown date but probably between on or around May 13, 2008 and on or around August 6, 2008, participated in the fabrication of a federal Notice of Assessment for the year 2007 concerning the promising buyer;

c) at an unknown date but probably around or about June 16, 2008, fabricated a “Donation Certificate” (attestation - remise de don) of a member of the defendant’s family for the promising buyer and signed under these circumstances in lieu of the donor;

and, under these circumstances, sent or allowed to be sent to the lending institution these documents, thus committing, on each of these occasions, an offence under Section 13 of the Rules of Professional Ethics of the ACAIQ;

2nd count: at an unknown date but probably around or about June 16, 2008, in the process of steps undertaken to obtain a financing secured by immovable hypothec for the acquisition of an immovable, performed an act of which the purpose was to confer a character of authenticity on the “Donation Certificate” (attestation - remise de don) of a member of the defendant’s family for the promising buyer by sending or allowing to be sent to the lending institution a bank statement showing that the donor had the necessary funds to cover this alleged donation, the whole contrary to Section 13 of the Rules of Professional Ethics of the ACAIQ;

3rd count: at an unknown date but probably during or around the month of February 2008, in the course of steps undertaken to obtain a financing secured by immovable hypothec for the acquisition of an immovable, participated in the fabrication of the following false documents:

a) an employment letter on February 14, 2008;

b) a pay slip on February 17, 2008;

and, under these circumstances, sent or allowed to be sent to the lending institution these documents, thus committing, on each of these occasions, an offence under Section 13 of the Rules of Professional Ethics of the ACAIQ;

4th count: at an unknown date but probably between on or around October 5, 2007 and on or around November 16, 2007, in the course of steps undertaken to obtain a financing secured by immovable hypothec for the acquisition of an immovable, fabricated the following false documents:

a) a “Donation Certificate” (attestation - remise de don);

b) employment letter;

and, under these circumstances, sent or allowed to be sent to the lending institution these documents, thus committing, on each of these occasions, an offence under Section 13 of the Rules of Professional Ethics of the ACAIQ;

On November 13, 2013, the Discipline Committee ordered a suspension of Mr. Hoang Khoi Nguyen’s real estate broker’s licence (licence no. D9482) for a total period of three (3) years on counts nos. 1, 2, 3 and 4 of the formal complaint, effective as of today.

This notice is given in accordance with Section 98.1 of the Real Estate Brokerage Act (R.S.Q., c. C-73.2) and section 33 of the Regulation respecting the issue of broker’s and agency licences (R.R.Q., c. C-73.2, r.3).
