MR. ANDRÉ DIOTTE’S LICENCE

NOTICE is hereby given that André Diotte, former real estate broker (Licence No. C8343), whose establishment was located in Montréal, has been found guilty by the Discipline Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ) of the offence summarized below:
1st count: On or around December 1, 2011, while he had to assess the value of an immovable, made gestures of a sexual nature towards a person without her consent, the whole contrary to section 62 of the Regulation respecting brokerage requirements, professional conduct of brokers and advertising.
On May 15, 2014, the Discipline Committee ordered the suspension of André Diotte’s real estate broker’s licence (Licence No. C8343) for a period of five (5) years on count No. 1 of the formal complaint.
In addition, the Discipline Committee has permanently restricted André Diotte’s right to engage in professional activities with his female clients without the presence of a third responsible adult person.
Given that André Diotte is no longer a licence holder, his licence will be suspended for a period of five (5) years whenever he becomes a licence holder again.
This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences (R.R.Q., c. C-73.2, r.3).
