NOTICE OF SUSPENSION OF
MR. GUERBY PERARD’S LICENCE

NOTICE is hereby given that Mr. Guerby Perard, former real estate broker (Licence No. E2224), whose establishment was located in Laval, has been found guilty by the Discipline Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ) of the offences summarized below:

1st count: Concerning an immovable, listed or allowed someone to list said immovable in the Greater Montreal Real Estate Board:

a) On or around February 14, 2008, by producing an MLS sheet;

b) On or around May 26, 2008, by producing an MLS sheet;
and this while the seller had not signed any brokerage contract; committing, on each of these occasions, an offence under section 43 of the Rules of Professional Ethics of the ACAIQ.

2nd count: On or around May 25, 2008, concerning an immovable, allowed a person other than the seller to sign a promise to purchase and its annexes, committing an offence under section 13 of the Rules of Professional Ethics of the ACAIQ.

3rd count: Between on or around May 24, 2008 and on or around June 5, 2008, in the course of steps undertaken to obtain a financing for the acquisition of an immovable, sent or allowed someone to send to an affiliated real estate agent information and/or documents he knew or should have known to be false concerning the borrower, committing an offence under section 35 of the Rules of Professional Ethics of the ACAIQ.

4th count: As of or around May 25, 2008, concerning an immovable, did not send without delay to the Manager of the establishment to which he was assigned the information and documents required for maintaining records, books and registers, including:

a) a brokerage contract dated February 12, 2008;

b) a brokerage contract dated May 24, 2008;

c) a promise to purchase and its annexes;

committing, on each of these occasions, an offence under section 147 of the ACAIQ By-Laws.

On April 22, 2014, the Discipline Committee ordered a suspension of Mr. Guerby Perard’s real estate broker’s licence (E2224) for a concurrent period of thirty (30) days on each of counts Nos. 1a) and 1b), a suspension period of sixty (60) days on count No. 2, a suspension period of ninety (90) days on count No. 3, and a concurrent period of thirty (30) days on each of the counts No. 4a), 4b) and 4c) of the formal complaint.

The suspension periods ordered on counts 1 and 4 shall be served concurrently, but consecutively to the other counts.

Given that Mr. Guerby Perard is no longer a licence holder, his licence will be suspended for a period of one hundred eighty days (180) whenever he becomes a licence holder again and consecutively to suspension periods ordered in file 33-13-1571.

This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences (R.R.Q., c. C-73.2, r.3).
