NOTICE OF SUSPENSION OF
MR. GAÉTAN LAFLÈCHE’S LICENCE

NOTICE is hereby given that Gaétan Laflèche, former real estate broker (Licence No. B2460), whose establishment was located in Sherbrooke, has notably been found guilty by the Discipline Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ) of the offences summarized below:

4th count: concerning an immovable, did not immediately send to the agency to which he was assigned, the information or documents required for maintaining records and registers, namely:

a) as of or around July 20, 2010, a brokerage contract;

b) as of or around December 30, 2010, an amendment and notice of fulfilment of conditions form;

c) as of or around March 25, 2011, a promise to purchase and its Annex AA;

d) as of or around March 27, 2011, a counter – proposal;

committing, on each of these occasions, an offence under section 1 of the Regulation respecting records, books and registers, trust accounting and inspection of brokers and agencies.

5th count: Concerning an immovable, during an investigation conducted by an assistant syndic, did not disclose all the facts he was aware of regarding the signing of a counter – proposal by a prospective buyer:

a) on or around February 13, 2013;

b) on or around February 20, 2013;

committing, on each of these occasions, an offence under section 105 of the Regulation respecting brokerage requirements, professional conduct of brokers and advertising.

On September 19, 2014, the Discipline Committee ordered the suspension of Gaétan Laflèche’s real estate broker’s licence (B2460) for a concurrent period of thirty (30) days on each of counts No. 4a), 4b), 4c) and 4d) and a concurrent period of ninety (90) days on each of counts No. 5a) and 5b).

The suspension periods for counts No. 4 and 5 of the formal complaint shall be served consecutively with each other.

Given that Gaétan Laflèche is no longer a licence holder, his licence will be suspended for a period of one hundred and twenty (120) days whenever he becomes a licence holder again.

This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences (R.R.Q., c. C-73.2, r.3).
