NOTICE OF SUSPENSION OF A LICENCE

NOTICE is hereby given that Dounia Najahi, former real estate broker, licence No. E5903, whose establishment was located in Montréal, has notably been found guilty by the OAICQ Discipline Committee of the offences summarized below:

Count 1: Between or around April 9 and 18, 2013, concerning an immovable:

a) Entering the name of the promising buyer on the promise to purchase;
b) Allowing someone other than the promising buyer to sign in lieu and stead of the latter on the following transaction documents:

i) on or about April 9, 2013, a promise to purchase;
ii) on or about April 11, 2013, a counter-proposal;
iii) on or about April 11 and 18, 2013, a counter-proposal;

c) Omitting and/or neglecting to adequately inform the promising buyer of her involvement concerning the purchase of the said immovable, this despite the fact that she knew or could not be unaware that the promising buyer had accepted to act, at that time, as co-borrower and not as buyer.

Count 3: On August 28, 2015, in the course of an investigation conducted by the assistant syndic concerning an immovable, falsely asserting that the signature appearing on 3 transaction documents was that of the promising buyer.

On July 5, 2016, the Discipline Committee ordered a suspension of Dounia Najahi’s licence No. E5903 for a period of 90 days, to be served whenever she becomes a licence holder again.

This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences (R.R.Q., c. C-73.2, r.3).
