NOTICE OF A LICENCE SUSPENSION

NOTICE is hereby given that Alexandre Renaud (Mohamed Ben Jemia), former real estate broker, licence No. F1275, whose establishment was located in Laval, has been found guilty by the OACIQ Discipline Committee of the offences summarized below:

Count 2: On the following three occasions, as of March 15, 2015, concerning the sale of an immovable he owned, did not avoid placing himself in a conflict of interest situation: a) by drafting 2 promises to purchase for prospective buyers; b) by participating in a meeting between the prospective buyer and the mortgage representative; c) by suggesting to the prospective buyer to have a third party act as a co-buyer to make it easier to obtain mortgage financing and complete the transaction.

Count 3: On or about March 15, 2015, concerning an immovable, received a cheque of $10,000 from the prospective buyer and did not deposit in a trust account and use it in accordance with clause 4.3 of the promise to purchase.

Count 4: On or about April 22, 2015, concerning an immovable, allowed false documents and / or inaccurate information to be sent to TD Bank as part of the prospective buyer’s financing application.

Count 5: On the following three occasions, on or around May 28, 2015, concerning an immovable: a) did not inform the acting notary that he was the real estate broker for that transaction; b) failing to ensure that the said notary has a copy of the promise to purchase and c) falsely told the said notary that he received a deposit of $32,000.

Count 6: On or about May 28, 2015, concerning an immovable, received remuneration directly and failed to remit it immediately to the agency he was acting for.

On May 18, 2017, the Discipline Committee ordered the suspension of Alexandre Renaud’s (Mohamed Ben Jemia) licence No. F1275 for a period of 180 days, to be served whenever he becomes a licence holder again.

This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences (R.R.Q., c. C-73.2, r.3).
