NOTICE OF SUSPENSION AND IMPOSITION OF RESTRICTIONS ON A LICENCE
NOTICE is hereby given that Richard Gérard, residential real estate broker, licence No. G7881, whose establishment is located in Gatineau, has been found guilty by the OACIQ Discipline Committee of the offences summarized below:
Count 1: On January 6, 2017, in Gantineau, in the case number 550-01-078274-141, was found guilty by the Court of Québec of the following two offences:
a) “On or about November 13, 2013, in Gantineau, District of Gatineau, by deceit, falsehood or other fraudulent means, defrauded the National Bank of Canada of an amount of $20,251.85, of a valuable security exceeding $5,000, thus committing a criminal act under section 380 (1) a) of the Criminal Code.”
b) “On or about November 13, 2013, in Gantineau, District of Gatineau, knowing or believing that a document was forged, i.e. a cheque from the Bank of Canada, used, dealt with or acted on it as if it were genuine, thus committing a criminal act under section 368 (1) a) (1.1) a) of the Criminal Code.”
Count 2: As of January 6, 2017, failed to immediately disclose to the OACIQ that he had been found guilty of criminal acts in court case number 550-01-078274-141.
On February 5, 2018, the Discipline Committee ordered the suspension of Richard Gérard’s licence No. G7881 for a period of 3 months, effective as of February 6, 2018.
The Discipline Committee also ordered the imposition of restrictions on Richard Gérard’s licence No. G7881 for a period of 5 years, i.e. the prohibition from signing any document relating to the management of a trust account, governed by the Real Estate Brokerage Act and the prohibition from acting on his own account and/or as agency executive officer. These restrictions will take effect on May 6, 2018.
This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences (R.R.Q., c. C-73.2, r.3).
