NOTICE is hereby given that Marco Melfi, real estate broker, licence No. A2419, whose establishment is located in Laval, has notably been found guilty by the OACIQ Discipline Committee of the offences summarized below:

Count 3: In Montreal, while acting as an executive officer of the real estate agency Comel Courtage immobilier Inc., used sums of money for purposes other than those for which they were entrusted to the said agency by withdrawing or allowing someone to withdraw illegally and/or prematurely the following sums from the trust account:

a) on or about February 22, 2016, an amount of $10,000;
b) on or about February 24, 2016, an amount of $15,000;
c) on or about March 4, 2016, an amount of $10,000;
d) on or about March 18, 2016, an amount of $15,000;
e) on or about April 8, 2016, an amount of $15,100;
f) on or about April 20, 2016, an amount of $1,200;
g) on or about June 22, 2016, an amount of $18,500;

Count 4: As of June 10, 2016, concerning an immovable, while acting as an executive officer of the real estate agency Comel Courtage immobilier Inc. and that the real estate agency Via Capital de l'Est M.T. had delegated the management of its trust account to it, defendant did not ensure that the sum of $3,000 given by the prospective buyer as a deposit is kept in the general trust account. 

On November 6, 2018, the Discipline Committee ordered the suspension of Marco Melfi’s licence No. A2419 for a total period of 18 months, effective January 4, 2019.

The Discipline Committee also imposed the following restrictions:

Prohibition from being designated as agency executive officer and from signing any document relating to the management of a trust account, governed by the Real Estate Brokerage Act, for a period of 5 years, to be served upon the expiration of the appeal period if the defendant is holder of a licence issued by the Organisme d’autoréglementation du courtage immobilier du Québec or, if not, whenever he becomes a licence holder again; 

The above-mentioned restrictions take effect on January 4, 2019 and end on January 4, 2024.

This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences (R.R.Q., c. C-73.2, r.3).
